Utah’s 2026 Advance Health Care Directive changes — and why Korean families should take note.
“갑자기 사고를 당해 의식을 잃는다면, 누가 나를 대신해 의료 결정을 내릴까요?” 배우자일까요? 자녀일까요? 아니면 병원이 정해주는 절차에 따라야 할까요?
“If I were suddenly in an accident and lost consciousness, who would make medical decisions for me?” Your spouse? Your children? Or would it fall to whatever procedure the hospital follows?
그리고 더 어려운 질문이 있습니다. 회복 가능성이 거의 없는 상황에서 인공호흡기를 계속 사용할 것인지, 의식을 회복할 가능성이 없다면 생명유지치료를 어느 정도까지 받을 것인지, 극심한 통증이 있다면 어떤 치료를 원하는지 — 가족들은 과연 내가 원하는 답을 알고 있을까요?
And there is a harder question. If there is little chance of recovery, should a ventilator be continued? If consciousness is not expected to return, how far should life-sustaining treatment go? If there is severe pain, what treatment would you want? Would your family actually know the answers you would have chosen?
우리는 상속을 준비한다고 하면 흔히 유언장이나 리빙트러스트부터 생각합니다. 하지만 가족에게 가장 어려운 결정이 필요한 순간은 사망한 뒤가 아니라, 내가 살아 있으면서도 스스로 말하거나 결정할 수 없을 때 찾아올 수도 있습니다. 이를 대비하기 위한 법률 문서가 사전의료지시서(Advance Health Care Directive, AHCD)입니다.
When we think of estate planning, we usually start with a will or a living trust. But the moment your family faces the hardest decision may come not after death, but while you are alive yet unable to speak or decide for yourself. The legal document that prepares for this is the Advance Health Care Directive (AHCD).
유타주는 2026년 1월 1일부터 새로운 Health Care Decisions 법체계를 시행했고, 이에 맞춘 새로운 Advance Health Care Directive 양식도 마련했습니다. 이번 변화는 단순히 서류 양식이 새로워졌다는 의미만은 아닙니다. 새로운 제도에서는 내가 의료 결정을 하지 못하게 되었을 때 누구를 의료 대리인으로 지정할 것인지, 생명유지치료에 대해 어떤 생각을 가지고 있는지, 통증 관리와 삶의 질 중 무엇을 중요하게 생각하는지, 그리고 예상하지 못한 의료상황에서 대리인에게 어느 정도 판단의 재량을 줄 것인지까지 보다 구체적으로 정할 수 있습니다.
Utah put a new Health Care Decisions framework into effect on January 1, 2026, along with a new Advance Health Care Directive form. This change is about more than a new form. Under the new framework you can decide, in greater detail, whom to name as your health care agent when you cannot decide, what you believe about life-sustaining treatment, whether you value pain management or quality of life more, and how much discretion to give your agent in situations no one foresaw.
특히 미국에 사는 한인 가정이라면 이 문제를 한번쯤 생각해 볼 필요가 있습니다. 부모님은 한국에 있고 자녀들은 미국의 다른 주에 살고 있을 수도 있습니다. 배우자는 영어가 익숙하지 않을 수도 있고, 한국의 가족과 미국의 가족이 치료 방향에 대해 서로 다른 의견을 가질 수도 있습니다. 그런 상황이 실제로 발생한 뒤 가족들에게 “환자분은 이런 상황에서 어떤 치료를 원하셨습니까?”라는 질문이 주어진다면, 가족들은 무엇이라고 답할 수 있을까요?
Korean families in the U.S., in particular, have reason to think this through. Your parents may be in Korea while your children live in another U.S. state. A spouse may not be comfortable in English, and family in Korea and family in the U.S. may disagree about the direction of care. If, after such a situation actually arises, the family is asked, “What treatment would the patient have wanted here?” — what would they be able to say?
이번 칼럼에서는 2026년 유타 사전의료지시서가 어떻게 달라졌는지, 기존 문서를 가지고 있다면 다시 작성해야 하는지, 배우자가 있다고 해도 왜 의료 대리인을 직접 지정해 두는 것이 중요한지, 그리고 Will이나 Living Trust와는 무엇이 다른지를 하나씩 살펴보겠습니다.
In this column we will look, one by one, at how Utah’s 2026 advance health care directive has changed, whether you need to redo an existing document, why it matters to name a health care agent yourself even if you have a spouse, and how this differs from a will or living trust.
아직 건강하고 이런 서류가 필요 없다고 생각하시는 분일수록 한번 읽어보셨으면 합니다. 사전의료지시서는 나이가 많거나 중병을 앓고 있는 사람에게만 필요한 문서가 아닙니다. 교통사고나 갑작스러운 질병처럼, 의료 결정을 할 수 없는 상황은 누구에게나 예고 없이 찾아올 수 있기 때문입니다.
The healthier you feel — the more you sense you don’t need this document — the more we hope you’ll read on. An advance health care directive is not only for the elderly or the seriously ill. A car accident or sudden illness can take away anyone’s ability to make medical decisions, without warning.
많은 분이 Estate Planning(상속·유산계획) 하면 유언장(Will)이나 리빙트러스트(Revocable Living Trust)를 먼저 떠올립니다. 그러나 Estate Planning은 사망 후 재산을 누구에게 남길지만 정하는 것이 아닙니다.
When people think of estate planning, the first documents that come to mind are usually a will or a revocable living trust. But estate planning is not only about who inherits your property after death.
사고나 중병으로 살아 있으면서도 스스로 의료 결정을 내릴 수 없는 상황이 올 수 있습니다. 누가 나를 대신해 의사와 상의할지, 어떤 치료를 받을지, 생명유지치료를 어디까지 원하는지 같은 문제는 상속재산보다 훨씬 먼저 가족 앞에 놓일 수 있습니다. 이를 대비하는 문서가 바로 사전의료지시서(Advance Health Care Directive, AHCD)입니다.
An accident or serious illness can leave you alive yet unable to make your own medical decisions. Who will speak with the doctors on your behalf, what treatment you will receive, and how far you want life-sustaining treatment to go — these questions can reach your family long before questions of inheritance do. The document that prepares for this is the Advance Health Care Directive (AHCD).
향후 스스로 의료 결정을 할 수 없는 상황을 대비해, 자신의 의사를 미리 남겨두는 법률 문서입니다. 유타주의 2026년 공식(statutory) 양식은 크게 두 가지 기능을 합니다.
It is a legal document that records your wishes in advance, for a time when you may be unable to make your own medical decisions. Utah’s 2026 statutory form serves two main functions.
- 의료 대리인 지정 — 나를 대신해 의료 결정을 내릴 Health Care Agent(의료 대리인)를 지정합니다.
- 희망·가치관 기록 — 향후 치료에 관한 희망사항, 우선순위, 가치관과 목표를 미리 기록합니다. 장기·조직 기증에 관한 의사도 포함할 수 있습니다.
- Naming an agent — you appoint a Health Care Agent to make medical decisions on your behalf.
- Recording wishes & values — you set down your wishes, priorities, values, and goals for future care. Organ and tissue donation wishes can be included as well.
유타주는 2026년 1월 1일부터 Utah Code Title 75A, Chapter 9의 새로운 Health Care Decisions 법체계를 시행하고 있습니다. 이에 맞추어 새로운 공식 Advance Health Care Directive 양식도 마련되었습니다. 그래서 새로 준비하시는 분은 물론, 이미 문서를 가지고 계신 분도 한 번 점검해 볼 시점입니다.
Since January 1, 2026, Utah has operated under a new Health Care Decisions framework in Utah Code Title 75A, Chapter 9. A new official Advance Health Care Directive form was introduced to match it. So this is a moment to review — both for those preparing a directive for the first time and for those who already have one.
2026년 유타법은 Power of Attorney for Health Care를 통해 나를 대신해 의료 결정을 내릴 Agent를 지정하도록 하고 있습니다. Agent의 의료 결정은 원칙적으로 별도의 법원 승인을 받아야만 효력이 생기는 것이 아닙니다. 공식 양식에서는 주된 Agent와 예비(Alternate) Agent를 각각 지정할 수 있습니다. 예비 Agent는 첫 번째 Agent가 사망했거나 연락되지 않거나 건강상 결정을 할 수 없는 경우를 대비한 것입니다.
Utah’s 2026 law lets you name an agent, through a Power of Attorney for Health Care, to make medical decisions for you. As a rule, the agent’s decisions do not require separate court approval to take effect. The official form lets you name both a primary agent and an alternate agent. The alternate is there in case the first agent has died, cannot be reached, or is unable to decide for health reasons.
Agent를 고를 때는 단순히 ‘가장 가까운 가족인가’보다 다음과 같은 현실적인 요소를 봅니다.
In choosing an agent, look less at ‘who is the closest relative’ and more at practical factors such as these.
- 내 의료적 가치관을 잘 이해하는 사람인지
- 긴급한 상황에서 연락이 되는지
- 의사와 의료진의 설명을 이해하고 질문할 수 있는지
- 가족 간 의견 충돌이 있어도 내 의사를 중심으로 판단할 수 있는지
- 실제로 이 역할을 맡을 의사가 있는지
- Whether they truly understand your medical values
- Whether they can be reached in an emergency
- Whether they can understand and question what the medical team explains
- Whether they can decide based on your wishes even amid family disagreement
- Whether they are actually willing to take on this role
누구를 먼저 고려하면 좋을까요? 대략 이런 순서로 생각해 보면 쉽습니다.
Whom should you consider first? It helps to think in roughly this order.
- 배우자 — 평소 내 가치관을 가장 잘 알고 위기 상황에서 판단력이 있다면 가장 자연스러운 선택
- 성인 자녀 — 특히 평소 부모의 병원 일정·의료정보를 챙겨온 자녀
- 형제자매·가까운 친척 — 더 침착하게 내 뜻을 대변할 수 있다면
- 믿을 수 있는 친구 — 가족이 아니어도 실제로 역할을 해낼 수 있다면
- 예비(Alternate) Agent도 함께 — 첫 번째 Agent가 연락되지 않거나 역할을 못 할 때를 대비
- Spouse — the most natural choice if they know your values best and can think clearly in a crisis
- Adult child — especially one who already manages your appointments and medical information
- Sibling or close relative — if they can represent your wishes more calmly
- Trusted friend — even if not family, if they can truly carry out the role
- An alternate agent too — in case the first agent can’t be reached or can’t serve
반대로 피하는 게 좋은 경우도 있습니다. 감정적으로 크게 흔들리는 사람, 가족의 압력에 쉽게 휘둘리는 사람, 내 의료관·종교적 가치와 충돌이 큰 사람, 연락이 잘 안 되는 사람은 아무리 가까운 가족이라도 적합하지 않을 수 있습니다.
Some people are better avoided. Someone easily overwhelmed emotionally, easily swayed by family pressure, in sharp conflict with your medical or religious values, or hard to reach may not be a good fit — even a close relative.
한인 가정이라면 한 가지 더 봅니다. 미국 의료 시스템과 영어 의료용어를 어느 정도 이해하고, 실제로 병원과 전화·이메일로 소통할 수 있는 사람인지입니다. 가족이 한국과 미국에 나뉘어 있다면, 현장에서 의료진과 가장 빨리 대응할 수 있는 사람이 누구인지도 중요합니다.
For Korean families, one more thing matters: whether the person understands the U.S. medical system and English medical terms well enough to communicate with the hospital by phone and email. If your family is split between Korea and the U.S., consider who can respond to the medical team fastest, on the ground.
네. 2026년 유타 공식 양식에서는 Agent에게 의료 결정 권한을 부여하면서 특정 권한을 제한할 수도 있습니다. 특별한 제한을 적지 않으면, 유타법이 Agent에게 허용하는 범위에서 의료 결정을 할 수 있도록 하는 구조입니다.
Yes. Utah’s 2026 form lets you grant your agent authority while also restricting specific powers. If you write no special limits, the structure is that the agent may make decisions within the scope Utah law allows.
따라서 AHCD를 작성할 때는 단순히 Agent의 이름만 적기보다, “이 사람에게 어느 정도까지 의료 결정을 맡길 것인가?”를 함께 검토하는 것이 중요합니다.
So when preparing an AHCD, it is important not merely to write the agent’s name, but also to consider “how far do I want to entrust medical decisions to this person?”
AHCD에서 가장 중요한 부분 중 하나가 생명유지치료(life-sustaining treatment)입니다. 2026년 유타 양식은 ‘연명치료를 원한다 / 원하지 않는다’는 이분법만 주지 않고, 상황을 구분해 본인의 의사를 표시하게 합니다. 예를 들어 다음과 같은 상태를 나누어 표시할 수 있습니다.
One of the most important parts of an AHCD is life-sustaining treatment. Utah’s 2026 form does not offer only a yes/no choice; it lets you express your wishes by distinguishing between situations, such as these.
- 치료를 하더라도 가까운 시일 내 사망할 것으로 예상되는 회복 불가능한 상태
- 의식을 회복할 것으로 예상되지 않는 상태
- 회복 가능성이 없고, 사랑하는 사람과 의사소통하거나 스스로를 돌보거나 가족·친구를 알아보는 능력을 잃은 상태
- An irreversible condition in which death is expected soon even with treatment
- A condition from which you are not expected to regain consciousness
- A condition with no prospect of recovery, having lost the ability to communicate with loved ones, care for yourself, or recognize family and friends
또한 생명을 유지하기 위해 장기간 인공적으로 음식이나 수분 공급이 필요한 경우에 대한 의사도 별도로 표시할 수 있습니다. 개인의 가치관과 종교적 신념, 의료적 상황에 따라 선택이 크게 달라지므로 일률적인 정답은 없습니다.
You can also separately indicate your wishes about prolonged, artificially supplied food or water needed to sustain life. Because these choices vary greatly with personal values, religious beliefs, and the medical situation, there is no one-size-fits-all answer.
임종기 의료에서 생명유지치료만큼 중요한 문제가 통증 조절과 편안함을 위한 치료입니다. 2026년 공식 양식은 심각한 통증이 있을 때, 편안함을 제공하기 위한 치료가 결과적으로 생명을 단축시킬 가능성이 있는 경우에도 그러한 치료를 원하는지에 대해 의사를 표시하게 합니다.
In end-of-life care, as important as life-sustaining treatment is treatment for pain control and comfort. The 2026 form lets you indicate whether, when you are in severe pain, you want comfort-focused treatment even if it could, as a side effect, shorten life.
따라서 AHCD는 단순히 ‘치료를 중단할 것인지’를 정하는 문서가 아닙니다. 내가 어떤 상태에서 생명 연장, 의식, 독립성, 통증 조절, 삶의 질 가운데 무엇을 중요하게 생각하는지를 의료진과 Agent가 이해하도록 하는 문서이기도 합니다.
So an AHCD is not merely a document about ‘whether to stop treatment.’ It is also a document that helps your medical team and agent understand what you value most — prolonging life, consciousness, independence, pain control, or quality of life — and in what circumstances.
미래에 발생할 모든 의료상황을 미리 예상해 적어 두는 것은 현실적으로 불가능합니다. 그래서 2026년 양식에는 본인의 우선순위(priorities)를 기록하는 부분이 마련되어 있습니다. 예를 들어 다음이 나에게 얼마나 중요한지 표시할 수 있습니다.
It is not realistic to anticipate and write down every future medical situation. That is why the 2026 form includes a place to record your priorities. For example, you can indicate how important each of the following is to you.
- 상당한 신체적 제약이 있어도 가능한 한 오래 생존하는 것
- 상당한 정신적·인지적 제약이 있어도 가능한 한 오래 생존하는 것
- 심각한 통증에서 벗어나는 것
- 독립적인 생활을 유지하는 것
- Agent가 중요한 결정 전에 가족과 상의하는 것 / 친구와 상의하는 것
- Living as long as possible even with significant physical limitations
- Living as long as possible even with significant mental or cognitive limitations
- Being free from severe pain
- Maintaining an independent life
- Having your agent consult family — or friends — before major decisions
또한 별도의 공간에 자신의 의료적 목표, 가치관, 원하는 치료 또는 원하지 않는 치료를 추가로 기록할 수도 있습니다. 이 부분은 실제 의료상황에서 상당히 중요합니다. 문서가 예상하지 못한 상황이 생겼을 때, Agent가 자기 생각으로 결정하는 것이 아니라 환자가 평소 중요하게 여긴 가치와 목표를 기준으로 판단할 수 있기 때문입니다.
You may also use a separate space to add your medical goals, values, and treatments you do or do not want. This can matter a great deal in real situations. When something the document did not anticipate arises, the agent can decide not by their own opinion but by the values and goals the patient consistently held.
네. 2026년 공식 양식에는 또 하나 중요한 선택이 있습니다. 내가 작성한 의료지시를 Agent가 그대로 엄격히 따라야 하는지, 아니면 예상하지 못한 상황에서 나의 best interest를 고려해 어느 정도 유연하게 적용할 수 있도록 할 것인지 선택할 수 있습니다.
Yes. The 2026 form includes another important choice. You can decide whether your agent must follow your written instructions strictly, or whether — in situations you did not foresee — the agent may apply them with some flexibility, considering your best interest.
공식 양식에 따르면, 이러한 유연성을 별도로 부여하지 않을 경우 Agent는 작성된 지시(instructions)를 따라야 하는 구조입니다. 그래서 이 조항을 선택할 때는 Agent와의 신뢰관계와 본인의 의료적 가치관을 함께 고려해야 합니다.
Under the official form, if you do not separately grant this flexibility, the agent must follow the written instructions. So in making this choice you should weigh both your trust in the agent and your own medical values.
Agent가 의료 결정을 내리려면 의료정보를 확인할 수 있어야 합니다. 유타의 2026년 양식은 본인이 의료 결정을 할 수 없는 상태가 되면 Agent가 의료정보를 확인하고 공유할 수 있도록 합니다.
To make medical decisions, your agent must be able to review your medical information. Utah’s 2026 form allows the agent to access and share that information once you are unable to make decisions.
또한 본인이 별도로 선택하면, incapacity(의사결정 무능력)가 발생하기 전이라도 Agent가 나를 돕기 위해 필요하다고 판단하는 경우 의료정보를 확인·공유할 수 있는 권한을 줄 수 있습니다. 특히 성인 자녀가 고령 부모의 의료관리를 돕고 있는 가정에서는 실무적으로 검토할 가치가 있습니다.
If you specifically choose, you can also grant the agent authority to access and share medical information even before incapacity, when the agent determines it is needed to help you. This is worth considering, in particular, in families where adult children help manage the care of aging parents.
2026년 공식 양식에는 자동으로 부여되지 않고 본인이 명시적으로 선택해야 하는 특별권한도 있습니다. 예를 들어 일정 기간 동안 Agent가 나를 정신건강 치료시설에 자발적(voluntary) 환자로 입원시키는 권한이나, 일정한 조건 아래 장기 nursing home 배치와 관련된 권한을 부여할 수 있습니다.
The 2026 form also contains special powers that are not granted automatically and that you must expressly select. For example, you may grant your agent the power to admit you, for a limited period, as a voluntary patient to a mental-health treatment facility, or, under certain conditions, powers related to long-term nursing-home placement.
이러한 권한은 일반적인 의료 결정과는 무게가 다르므로, 해당 조항을 선택하기 전에 그 의미를 충분히 이해하는 것이 좋습니다.
These powers carry a different weight than ordinary medical decisions, so it is wise to fully understand what they mean before selecting them.
AHCD를 작성한다고 해서 Guardian이 자동으로 선임되는 것은 아닙니다. 다만 향후 어떤 이유로 법원이 Guardian을 선임해야 하는 상황을 대비해, 누구를 Guardian으로 선호하는지 미리 표시할 수 있습니다.
Creating an AHCD does not automatically appoint a guardian. But in case a court later needs to appoint one for some reason, you can indicate in advance who you would prefer as guardian.
2026년 유타 양식에는 현재 지정한 Agent나 예비 Agent를 선호하는 Guardian으로 지명하거나, 다른 사람을 따로 지정할 수 있는 항목이 있습니다. 이는 incapacity planning을 Will이나 Trust와 함께 검토해야 하는 또 하나의 이유입니다.
Utah’s 2026 form includes an item to nominate your current agent or alternate as the preferred guardian, or to name someone else. This is one more reason to review incapacity planning together with your will or trust.
네. 2026년 공식 AHCD 양식은 사망 후 organ, tissue and body-part donation(장기·조직·신체 부위 기증)에 관한 의사를 남기게 합니다. 기증을 선택하는 경우 그 목적도 표시할 수 있습니다.
Yes. The 2026 official AHCD form lets you record wishes regarding organ, tissue, and body-part donation after death. If you choose to donate, you can also indicate the purpose.

공식 양식은 장기기증을 위해 필요한 치료가 다른 의료지시와 충돌할 가능성까지 고려한 선택지를 두고 있습니다.
The official form even includes options that account for the possibility that treatment needed for donation may conflict with your other medical instructions.
반드시 그렇게 단순하게 볼 수는 없습니다. 2026년 유타법에는, 본인이 의료 결정을 할 능력(capacity)을 잃었고 이용 가능한 Agent나 의료결정 권한을 가진 Guardian이 없는 경우에 적용되는 default surrogate(기본 대리결정자) 제도가 있습니다. 법은 일정한 우선순위를 두며, 여기에는 특정 조건을 충족하는 배우자, 성인 자녀 또는 부모, 동거인(cohabitant), 성인 형제자매 등이 포함됩니다.
It is not that simple. Utah’s 2026 law includes a default surrogate system that applies when you have lost capacity to make medical decisions and there is no available agent or guardian with authority to decide. The law sets a priority order that includes, among others, a spouse who meets certain conditions, an adult child or parent, a cohabitant, and an adult sibling.
따라서 AHCD가 없다고 해서 언제나 법원이 먼저 Guardian을 선임해야만 의료 결정을 할 수 있는 것은 아닙니다.
So the absence of an AHCD does not always mean a court must first appoint a guardian before any medical decision can be made.
AHCD를 작성하는 가장 중요한 이유 중 하나가 바로 이 불확실성을 줄이고, 본인이 선택한 사람에게 의사결정 역할을 맡길 수 있다는 것입니다.
One of the most important reasons to create an AHCD is precisely to reduce this uncertainty and place the decision-making role with the person you have chosen.
아닙니다. Utah Code § 75A-9-128은 2026년 1월 1일 이전에 작성된 AHCD도, 작성 당시 해당 주의 법률에 따라 유효하게 만들어졌다면 계속 유효할 수 있도록 규정합니다. 또한 새로운 Chapter 9은 2026년 1월 1일 이전·당일·이후에 작성된 AHCD에 적용됩니다. 그래서 기존 서류가 있다는 이유만으로 반드시 다시 작성해야 하는 것은 아닙니다.
No. Utah Code § 75A-9-128 provides that an AHCD created before January 1, 2026 can remain valid if it was validly made under the law of the relevant state at the time. The new Chapter 9 also applies to AHCDs created before, on, or after January 1, 2026. So simply having an older document does not mean you must redo it.
다만 오래된 AHCD를 가지고 있다면 다음은 다시 검토할 가치가 있습니다.
That said, if you have an older AHCD, the following are worth revisiting.
- 현재 Agent로 지정한 사람을 여전히 신뢰하는가
- Agent의 전화번호·주소 등 연락정보가 지금도 정확한가
- 결혼, 이혼, 재혼 또는 가족관계 변화가 있었는가
- 의료적 가치관이나 생명유지치료에 대한 생각이 달라졌는가
- 2026년 양식이 제공하는 추가 선택사항을 이용하고 싶은가
- Whether you still trust the person named as agent
- Whether the agent’s contact details (phone, address) are still accurate
- Whether there has been a marriage, divorce, remarriage, or other family change
- Whether your medical values or views on life-sustaining treatment have changed
- Whether you want to use the additional options the 2026 form offers
그렇게 단정할 수는 없습니다. Utah Code § 75A-9-110은 현재 양식을 “Optional form(선택 양식)”으로 규정합니다. 즉 유타법에 따라 AHCD를 만드는 데 사용할 수 있는 양식이지, 모든 사람이 반드시 이 서식만 써야 한다는 의미는 아닙니다.
Not necessarily. Utah Code § 75A-9-110 designates the current form as an “optional form.” That is, it is a form you may use to make an AHCD under Utah law — not one that everyone is required to use.
