Parents who own a home in Texas often ask: “I want to leave my house to my child — is a will all I need?” Or, “If I set up a Transfer on Death Deed, do I even need a living trust?”

결론부터 말하면, Will, Transfer on Death Deed(TOD Deed 또는 TODD), Revocable Living Trust는 모두 집을 자녀에게 남기는 데 사용할 수 있지만, 법적으로 작동하는 방식은 상당히 다릅니다. 가장 큰 차이는 세 가지입니다.

The short answer: a Will, a Transfer on Death Deed (TOD Deed or TODD), and a Revocable Living Trust can all be used to leave a house to a child — but they work quite differently under the law. The three biggest differences are these.

가장 흔한 오해입니다. Will이 있다고 해서 probate을 피하는 것은 아닙니다. TexasLawHelp도 Will은 재산이 원하는 사람에게 가도록 정할 수 있지만, 일부 재산의 명의를 변경하려면 Will을 probate court에 제출해 법원의 인정을 받아야 한다고 설명합니다.

This is the most common misconception. Having a will does not, by itself, avoid probate. TexasLawHelp explains that while a will can direct property to the people you choose, changing title to certain property generally requires submitting the will to a probate court for recognition.

In other words, this sequence typically follows: Will → death → probate → executor administers the estate → the house is transferred to the child

다만 텍사스는 Independent Administration 제도가 잘 발달되어 있어, 제대로 작성된 Will이 있고 Independent Executor를 지정했다면 probate가 비교적 효율적으로 진행될 수 있습니다(Texas Estates Code Chapter 401). 따라서 “probate가 있으니 Will은 나쁘고 Trust는 좋다”고 단정하는 것은 정확하지 않습니다.

That said, Texas has well-developed independent administration, so with a properly drafted will naming an independent executor, probate can proceed relatively efficiently (Texas Estates Code Chapter 401). So it is not accurate to conclude, “probate exists, therefore wills are bad and trusts are good.”

Q3유언장은 집을 넘기는 것 말고 어떤 역할을 하나요?Beyond passing on a house, what else does a will do?

Will은 부동산 하나만을 위한 문서가 아닙니다. 일반적으로 다음을 함께 설계할 수 있습니다.

A will is not a document for a single property. Through it you can generally plan for the following.

  • 누가 Estate의 Executor가 될 것인지

그래서 TOD Deed나 Living Trust를 사용하더라도 Will을 함께 준비하는 경우가 일반적입니다. Living Trust 중심으로 설계한 경우에도, Trust에 미처 이전되지 않은 재산을 Trust로 넘기는 Pour-Over Will을 함께 두는 경우가 많습니다(State Bar of Texas).

텍사스에는 Transfer on Death Deed, 줄여서 TODD라는 제도가 있습니다. Texas Estates Code Chapter 114의 정식 명칭은 Texas Real Property Transfer on Death Act입니다. 부동산 소유자가 자신이 사망할 때 해당 부동산을 한 명 이상의 beneficiary에게 이전하도록 미리 deed를 작성할 수 있게 합니다.

Texas has a mechanism called the Transfer on Death Deed, or TODD. The formal name of Texas Estates Code Chapter 114 is the Texas Real Property Transfer on Death Act. It lets a property owner prepare, in advance, a deed transferring the property to one or more beneficiaries at death.

“내가 사망하면 Dallas의 이 집은 아들에게 이전된다.”라고 TOD Deed에 지정하고, 법적 요건을 갖추어 등기해 놓을 수 있습니다.

적법하게 작성·등기된 TOD Deed가 있다면, 해당 부동산은 원칙적으로 사망 시 지정된 beneficiary에게 이전됩니다. 즉, 해당 부동산의 probate을 피할 수 있습니다. Texas Estates Code §114.051은 개인이 자신의 Texas real property interest를 사망 시 효력이 발생하도록 beneficiary에게 이전할 수 있도록 규정하고, TexasLawHelp도 TODD를 probate court를 거치지 않고 부동산을 이전하는 방법으로 설명합니다.

With a validly drafted and recorded TOD Deed, the property generally passes to the designated beneficiary at death — meaning it can avoid probate for that property. Texas Estates Code §114.051 provides that an individual may transfer a Texas real property interest to a beneficiary effective at death, and TexasLawHelp describes a TODD as a way to transfer real property without going through probate court.

따라서 “텍사스에 집 한 채가 있고, 내가 죽으면 성인 자녀 한 명에게 그대로 주고 싶다”처럼 자산구조가 단순하다면, TOD Deed는 상당히 실용적인 도구가 될 수 있습니다.

So if your assets are simple — “I have one house in Texas and want to give it, as-is, to one adult child” — a TOD Deed can be a very practical tool.

Q6TOD Deed를 만들면 자녀가 지금 공동소유자가 되나요?Does a TOD Deed make my child a co-owner now?

아닙니다. Texas Estates Code §114.101에 따르면, 소유자가 살아 있는 동안 TOD Deed는 소유자의 매각권·담보설정권·homestead rights·재산세 exemption에 영향을 주지 않고, beneficiary에게 현재의 법적·형평법상 소유권을 만들어 주지도 않습니다.

No. Under Texas Estates Code §114.101, while the owner is alive a TOD Deed does not affect the owner’s right to sell, right to mortgage, homestead rights, or property tax exemptions, and it creates no present legal or equitable ownership in the beneficiary.

따라서 부모는 TOD Deed를 만든 뒤에도 계속 집을 살 수도, 팔 수도, refinance할 수도 있습니다. 생전에 자녀 이름을 deed에 공동소유자로 올려버리는 방법과는 큰 차이가 있습니다.

So even after making a TOD Deed, the parent can continue to live in, sell, or refinance the home. This differs greatly from adding the child as a co-owner on the deed during life.

Q7TOD Deed는 나중에 취소하거나 바꿀 수 있나요?Can I revoke or change a TOD Deed later?

가능합니다. TOD Deed는 revocable(취소 가능)합니다. Texas Estates Code §114.052는 이를 명시하고, §114.057은 일정한 방식의 revocation 또는 새로운 TOD Deed로 기존 지정을 바꿀 수 있게 합니다. 그런데 아주 중요한 함정이 있습니다.

Yes. A TOD Deed is revocable. Texas Estates Code §114.052 states this, and §114.057 lets you change an existing designation by a proper revocation or a new TOD Deed. But there is an important trap.

나중에 Will을 새로 쓴다고 TOD Deed가 자동으로 없어지지 않습니다

Writing a new will later does not automatically cancel a TOD Deed

TOD Deed에는 “집은 아들에게”, 나중 Will에는 “집은 딸에게”라고 되어 있어도, Will을 새로 썼다고 TOD Deed가 없어지지 않습니다. Texas Estates Code §114.057(b)는 Will이 TOD Deed를 revoke하거나 supersede할 수 없다고 명시합니다. 문서 간 beneficiary가 다르면 큰 분쟁이 생길 수 있습니다.
Even if a TOD Deed says “house to my son” and a later will says “house to my daughter,” the new will does not cancel the TOD Deed. Texas Estates Code §114.057(b) states a will cannot revoke or supersede a TOD Deed. Conflicting beneficiaries across documents can cause serious disputes.

No. It is not a document you sign and put in a drawer. Under Texas Estates Code §114.055, to be effective it must generally meet the form for a recordable deed, state that transfer occurs at death, and — above all — be recorded in the deed records of the county where the property is located before the owner dies.

예를 들어 집이 Collin County에 있다면 그 county의 real property records에 recording하는 과정이 중요합니다. 사망 후 서랍에서 서명된 TOD Deed를 발견해 뒤늦게 등기하여 효력을 발생시킬 수 있는 구조가 아닙니다.

For example, if the house is in Collin County, recording it in that county’s real property records is essential. If a signed TOD Deed is found in a drawer after death, it cannot be recorded late to give it effect.

Q9TOD Deed로 집을 받으면 mortgage도 사라지나요?If a house passes by TOD Deed, does the mortgage disappear?

아닙니다. TOD Deed는 집에 붙어 있는 mortgage나 lien을 없애주는 제도가 아닙니다. Texas Estates Code §114.104에 따르면 beneficiary는 원칙적으로 사망 당시 그 부동산에 존재하는 mortgage·lien·encumbrance 및 기타 부담을 그대로 안고 부동산을 받습니다.

No. A TOD Deed does not remove a mortgage or lien attached to the house. Under Texas Estates Code §114.104, the beneficiary generally takes the property subject to any mortgage, lien, encumbrance, and other burdens existing at death.

집 시가가 $600,000, mortgage가 $250,000 남아 있다면, 깨끗한 $600,000짜리 집이 아니라 mortgage가 걸린 상태의 부동산을 받는 것입니다.
If the house is worth $600,000 with a $250,000 mortgage, the child receives not a clean $600,000 house but the property still subject to the mortgage.
Q10TOD Deed면 부모의 채권자로부터 안전한가요?Does a TOD Deed protect the house from creditors?

완전히 그렇지는 않습니다. TOD Deed가 재산을 probate 밖으로 이전한다고 해서 모든 creditor claim으로부터 절대적으로 보호되는 것은 아닙니다. Texas Estates Code §114.106은 Estate의 다른 재산이 부족한 경우, 일정한 Estate claim·administration expense·estate tax 또는 일부 statutory allowance를 충당하기 위해 TODD로 이전된 부동산에 책임을 추궁할 수 있도록 합니다. 따라서 TOD Deed를 단순한 “채권자 보호용 deed”로 이해하면 안 됩니다.

Not entirely. Transferring property outside probate does not make it absolutely protected from all creditor claims. Texas Estates Code §114.106 allows property transferred by a TODD to be reached — where other estate assets are insufficient — to satisfy certain estate claims, administration expenses, estate taxes, or statutory allowances. So a TOD Deed should not be seen as merely a “creditor-protection deed.”

Q11여러 자녀에게 TOD Deed로 남기면 어떻게 되나요?What if I leave the house to several children by TOD Deed?

예상치 못한 공동소유 문제가 생길 수 있습니다. Texas Estates Code §114.103은 특별히 다르게 정하지 않는 한, 여러 beneficiary에게 concurrent interests가 이전될 경우 equal and undivided shares로 이전되도록 규정합니다. 세 자녀가 각각 집의 1/3 지분을 갖게 될 수 있습니다. 그러면 이런 문제가 생깁니다.

It can create unexpected co-ownership problems. Unless you specify otherwise, Texas Estates Code §114.103 provides that concurrent interests passing to multiple beneficiaries transfer as equal and undivided shares. Three children may each hold a 1/3 interest. Then these problems arise.

  • 첫째는 집을 팔고 싶어 합니다.

A TOD Deed is efficient at transferring the house, but it does not resolve how the family manages it afterward. This is exactly where a living trust differs.

Q12리빙 트러스트(Living Trust)는 무엇이 다른가요?How is a Living Trust different?

구조가 다릅니다. Trust를 만들고 텍사스 부동산을 적절히 Trust로 이전하면, 집의 title은 Trust 구조 안에서 관리됩니다. Trust를 만든 사람(Settlor)이 생전에는 대개 본인이 Trustee로서 집을 관리하고, 사망 또는 incapacity가 발생하면 미리 지정한 Successor Trustee가 Trust 문서에 따라 재산을 관리합니다.

Its structure is different. Once you create the trust and properly transfer the Texas property into it, title is managed within the trust. During life the creator (settlor) usually manages the house as trustee, and at death or incapacity a pre-named successor trustee manages it per the trust document.

Texas Property Code §112.051은 Trust가 문서상 irrevocable이라고 명시되지 않은 경우 Settlor가 Trust를 revoke할 수 있게 하고, amendment도 인정합니다. 즉 일반적인 Revocable Living Trust는 부모가 살아 있는 동안 통제권을 상당 부분 유지하면서 사후 관리 계획까지 설계할 수 있는 구조입니다.

Texas Property Code §112.051 lets the settlor revoke a trust unless it states it is irrevocable, and recognizes amendment. So a typical revocable living trust lets a parent retain substantial control during life while designing a plan for management after death.

Q13트러스트를 만들기만 하면 probate을 피하나요?Does simply creating a trust avoid probate?

아닙니다 — 이것이 가장 중요한 실무 포인트입니다. Trust 서류만 만들고 집 deed가 여전히 개인 이름으로 되어 있다면, 기대한 probate 회피가 이루어지지 않을 수 있습니다. State Bar of Texas도 Living Trust가 probate을 피하려면 자산을 실제로 Trust에 이전해 fully fund하는 것이 중요하다고 설명합니다.

No — and this is the most important practical point. If you make the trust documents but the deed still stands in your individual name, the probate avoidance you expected may not happen. The State Bar of Texas explains that for a living trust to avoid probate, you must actually transfer assets into it and fully fund it.

쉽게 말하면 — Trust 문서 작성 + 부동산을 Trust로 이전(funding)이 함께 이루어져야 합니다. Trust만 만들고 deed를 바꾸지 않은 채 사망하면, 그 부동산이 Trust 바깥에 남아 probate 대상이 될 수 있습니다.

네. TOD Deed는 기본적으로 “사망하면 누가 집을 받는가”에 초점을 둡니다. 그러나 부모가 살아 있는 동안 치매·뇌졸중·사고 등으로 재산을 직접 관리하기 어려워질 수 있습니다. Revocable Living Trust에서는 이런 경우 Successor Trustee가 Trust 문서에 따라 재산관리를 이어받도록 설계할 수 있습니다(Houston Bar Association Elder Law). 이는 단순한 TOD Deed에는 없는 중요한 기능입니다.

Yes. A TOD Deed focuses on “who gets the house at death.” But during life, dementia, a stroke, or an accident can make it hard for the parent to manage the property. In a revocable living trust, you can design for a successor trustee to take over management under the trust document (Houston Bar Association elder law). This is an important function a plain TOD Deed lacks.

Q16그럼 리빙 트러스트가 무조건 가장 좋은가요?So is a living trust always the best choice?

If your situation is one Texas house · a few accounts · one or two adult children · low dispute risk · no complex conditional inheritance, then a well-drafted will + beneficiary designations + a TOD Deed can already be efficient.

Q18아무 준비도 하지 않으면 어떻게 되나요?What happens if I do nothing at all?

가장 위험한 선택입니다. “자녀가 한 명이니 알아서 받겠지”라고 생각하지만, 아무 준비 없이 사망하면 텍사스의 intestate succession law(무유언 상속법)에 따라 상속인이 결정됩니다.

This is the riskiest choice. People assume “I have one child, so they’ll get it anyway,” but if you die with no plan, heirs are set by Texas intestate succession law.
