EB-1은 한국 할당 대상 기준 계속 Current입니다. Extraordinary Ability, Outstanding Professor·Researcher, Multinational Manager·Executive 대상자에게는 여전히 좋은 환경입니다. (참고로 인도 출생 EB-1은 2022년 10월 15일에 머물러 있고, 국무부는 인도 한도 도달 시 연내 Unavailable 가능성을 경고했습니다.)
EB-2 역시 한국 기준 Current이며 NIW를 포함해 매우 유리한 상태입니다. 다만 국무부는 9월에도 FY2026 종료 전 EB-2 후퇴 또는 Unavailable 가능성을 명시했습니다. 자격이 갖춰진 신청자라면 단순히 "지금 Current"라는 이유로 준비를 늦추기보다, 청원서와 Adjustment of Status 접수 가능 여부를 신속히 검토하는 것이 합리적입니다.
EB-1A와 EB-2 NIW는 고용주 스폰서나 PERM 없이 본인이 직접 청원(Self-Petition)할 수 있는 카테고리입니다. 다만 승인은 학력·경력만으로 결정되지 않으며, 성과·업계 영향력·연구/출판·수상·언론 보도·추천서, 그리고 미국 경제·산업·과학기술 발전 기여 가능성을 객관적으로 입증하는 것이 핵심입니다.
EB-3(전문직·숙련공) 한국 할당 대상 Final Action Date는 2024년 9월 1일로 8월과 동일하고, 비숙련공(Other Workers)도 2022년 4월 1일로 유지되었습니다. Dates for Filing 기준으로는 일반 EB-3가 Current, Other Workers가 2022년 8월 1일로 유지됩니다.
미국 내 I-485는 USCIS가 Dates for Filing 사용을 허용하지 않는 한 Final Action Dates가 기본 기준입니다. 따라서 EB-3 신청자의 접수 가능 여부는 본인의 우선일자가 Final Action Date(전문직·숙련공 2024.09.01 / Other Workers 2022.04.01)보다 앞서 있는지로 판단하되, 접수 직전 해당 월 USCIS 차트를 확인하세요.
특수이민 EB-4 Final Action Date는 2022년 12월 15일로 2개월 전진했습니다. EB-4에는 여러 Special Immigrant 유형이 포함되며, 종교이민(Certain Religious Workers)도 Visa Bulletin상 같은 날짜가 적용됩니다. 다만 특정 비성직 종교종사자 프로그램은 별도의 법적 sunset(일몰) 또는 연장 규정이 적용될 수 있으므로, Visa Bulletin만으로 신청 가능 여부를 판단해서는 안 됩니다.
9월에도 한국 할당 대상 EB-5는 Unreserved · Rural · High Unemployment · Infrastructure 전 카테고리가 Current(C)입니다. 숫자 자체는 좋은 상태입니다.
그러나 9월부터 EB-5 Unreserved에 새로운 국무부 공식 경고가 추가됐습니다. 충분한 수요와 증가한 번호 사용으로 FY2026 종료 전 Unreserved의 Final Action을 후퇴시키거나 Unavailable로 만들 수 있다는 내용으로, 8월 Bulletin에는 없던 항목입니다. EB-5 Unreserved를 진행 중이거나 Unreserved 사건으로 I-526/I-526E 승인 후 다음 단계를 준비 중인 신청자라면 9월의 Current를 가볍게 볼 수 없습니다. 반면 Rural·High Unemployment·Infrastructure 등 Set-Aside 카테고리는 이번 경고의 직접 대상이 아니며, 9월 공식표에서도 계속 Current입니다.
FY2026 마지막 달이라는 점이 중요합니다 — 9월 30일은 FY2026의 마지막 날입니다. 국무부는 연간 한도를 넘길 수 없으므로 남은 번호를 최대한 효율적으로 사용하면서도, 수요가 예상보다 빠르면 언제든 특정 카테고리를 retrogress하거나 Unavailable로 바꿀 수 있습니다. 이번 Bulletin에는 EB-1 인도, EB-2, EB-5 Unreserved 세 경고가 동시에 존재합니다. "9월 문호가 좋다"는 것과 별개로, 문호가 열려 있는 동안 실제 접수 가능한 사람에게는 오히려 신속한 판단이 필요한 시기입니다.
문호가 크게 움직이는 달에는 CSPA(Child Status Protection Act)가 특히 중요합니다. 자녀가 21세에 가까운 신청자는 단순히 실제 나이만 보고 판단해서는 안 됩니다. 또한 USCIS는 2025년 8월 15일부터 시행된 정책에 따라, 일반적으로 CSPA 연령 계산을 위한 visa availability를 판단할 때 Final Action Dates chart를 기준으로 사용합니다. 다만 2025년 8월 15일 이전부터 USCIS에 계류 중인 일부 Adjustment of Status 사건에는 종전 정책이 적용될 수 있습니다.
따라서 자녀가 21세에 가까운 사건이라면 ① 우선일자, ② 청원서 pending period, ③ visa availability 시점, ④ sought-to-acquire requirement까지 함께 계산해야 합니다. CSPA는 몇 개월 차이로 파생 영주권 자격이 달라질 수 있어, 단순한 온라인 계산만으로 판단하는 것은 위험합니다.
한국에 거주하며 미국 대사관을 통해 immigrant visa를 진행하는 신청자와, 미국 내에서 Form I-485를 제출하는 신청자는 절차가 다릅니다. 해외 Consular Processing은 국무부와 National Visa Center 절차가 중심이고, 미국 내 Adjustment of Status는 그 달 USCIS가 지정한 차트가 I-485 접수 여부에 직접 영향을 줍니다.
그러므로 단순히 Visa Bulletin에서 Dates for Filing이 본인 우선일자보다 앞서 있다는 이유만으로 "지금 I-485를 넣을 수 있다"고 단정해서는 안 됩니다. USCIS가 Dates for Filing 사용을 허용하지 않는 한 Final Action Dates가 기준이며, 반드시 해당 월 USCIS가 지정한 차트를 확인해야 합니다.

Family Categories Surge Forward — F3·F4 Advance 2+ Years, EB-2·EB-5 Face FY2026 Year-End Exhaustion Warnings
September is the final month of the federal fiscal year (FY2026). On the family side, every category — F1·F2A·F2B·F3·F4 — advanced, with F2B·F3·F4 each jumping forward by one to two years at once. On the employment side, for applicants charged to Korea, EB-1·EB-2·EB-5 remain Current — but the State Department has formally warned that EB-2 and, for the first time, EB-5 Unreserved could retrogress or become Unavailable before the fiscal year ends. With availability now wide open, there is added urgency to use the window before year-end exhaustion.
For September F2A, the State Department explains that numbers exempt from the per-country limit are available to priority dates before August 22, 2025, and for applicants subject to the per-country limit (except Mexico) to priority dates from August 22, 2025 to before August 22, 2026. For applicants charged to Korea, this is a very favorable environment.
Even if you file EAD and AP concurrently, merely filing Form I-131 does not automatically authorize international travel. If you depart the U.S. while your Adjustment of Status (I-485) is pending before Advance Parole is approved, your I-485 may be deemed abandoned. If urgent travel is unavoidable, confirm that AP has been approved and consult an attorney first. (Certain statuses such as H-1B and L-1 may qualify for an exception.)
Applicants with priority dates around F1: early 2019–2020, F2B: 2018–2019, F3: 2012–2014, F4: 2009–2011 should re-check whether their case now falls within the Final Action or Filing range. In long-waiting categories, rather than simply waiting on the dates, review the following together.
Why did family availability move so much in September? — In the September Bulletin, the State Department explained directly that recent U.S. government entry and visa measures have reduced immigrant-visa issuance rates for applicants from certain countries, and that to fully use the numbers available in FY2026 it advanced the dates for several family and employment categories. In other words, this large jump reflects year-end number management (matching available numbers to actual demand) rather than a sudden drop in demand. At the same time, the State Department noted that if demand rises again or administrative measures change, the dates could retrogress.
Key caution — For applicants charged to Korea, September employment categories keep EB-1·EB-2·EB-5 Current, EB-3 held, and only EB-4 advanced (2 months). The numbers look stable — but in the September Bulletin the State Department set out three simultaneous warnings: EB-1 India possibly Unavailable, EB-2 possible retrogression or Unavailable, and — new in September — EB-5 Unreserved possible retrogression or Unavailable. In this final month of FY2026, number management is very tight.
EB-1 remains Current for applicants charged to Korea. For those in the Extraordinary Ability, Outstanding Professor/Researcher, and Multinational Manager/Executive subcategories, it is still a favorable environment. (For reference, EB-1 for those born in India sits at October 15, 2022, and the State Department has warned it could go Unavailable this year if India's limit is reached.)
EB-2 is likewise Current for Korea and very favorable, including NIW. However, the State Department again flagged in September a possible EB-2 retrogression or Unavailability before FY2026 ends. If your case is eligible, rather than delaying simply because it is "Current now," it is prudent to promptly review whether the petition and Adjustment of Status can be filed.
EB-1A and EB-2 NIW allow you to self-petition without an employer sponsor or PERM. Approval, however, is not decided by degree or experience alone — the key is objectively documenting achievements, industry impact, research/publications, awards, media coverage, recommendation letters, and prospective contribution to the U.S. economy, industry, science, and technology.
The EB-3 (skilled/professional) Final Action Date for applicants charged to Korea is September 1, 2024, the same as August, and Other Workers held at April 1, 2022. On the Dates for Filing chart, standard EB-3 is Current and Other Workers is August 1, 2022.
In the U.S., unless USCIS permits Dates for Filing, Final Action Dates are the default standard. So an EB-3 applicant's ability to file turns on whether their priority date is before the Final Action Date (Skilled/Prof 09/01/2024 / Other Workers 04/01/2022) — and you should still check that month's USCIS chart before filing.
The EB-4 (Special Immigrant) Final Action Date advanced two months to December 15, 2022. EB-4 covers several Special Immigrant types, and Certain Religious Workers share the same date on the Visa Bulletin. However, certain non-minister religious-worker programs may be subject to a separate statutory sunset or extension, so do not judge filing eligibility from the Visa Bulletin alone.
In September, EB-5 for applicants charged to Korea remains Current (C) across all categories — Unreserved · Rural · High Unemployment · Infrastructure. The numbers themselves are in good shape.
But starting in September a new official State Department warning was added for EB-5 Unreserved: sufficient demand and increased number use may require retrogressing the Unreserved Final Action or making it Unavailable before FY2026 ends — an item that was not in the August Bulletin. Applicants pursuing EB-5 Unreserved, or preparing the next step after I-526/I-526E approval on an Unreserved case, cannot take September's Current lightly. By contrast, the Rural · High Unemployment · Infrastructure set-aside categories are not the direct target of this warning and remain Current on the September chart.
The final month of FY2026 matters — September 30 is the last day of FY2026. Because the State Department cannot exceed the annual limits, it uses remaining numbers as efficiently as possible but may retrogress or make a category Unavailable at any time if demand runs faster than expected. This Bulletin carries three simultaneous warnings — EB-1 India, EB-2, and EB-5 Unreserved. Separate from "September looks good," for those who can actually file while the window is open, this is a time that calls for prompt decisions.
In months when the dates move significantly, the Child Status Protection Act (CSPA) is especially important. For an applicant whose child is near age 21, you cannot judge by the child's actual age alone. Under a policy effective August 15, 2025, USCIS generally uses the Final Action Dates chart to determine visa availability for CSPA age calculation. That said, certain Adjustment of Status cases pending with USCIS before August 15, 2025 may continue to be governed by the prior policy.
So for a case where the child is near 21, you must calculate together ① the priority date, ② the petition's pending period, ③ the point of visa availability, and ④ the sought-to-acquire requirement. Because a few months can change derivative green-card eligibility, relying on a simple online calculator alone is risky.
An applicant processing an immigrant visa through a U.S. embassy while living in Korea, and an applicant filing Form I-485 inside the U.S., follow different procedures. Overseas Consular Processing centers on the State Department and the National Visa Center, while U.S. Adjustment of Status is directly affected by the chart USCIS designates for that month.
Therefore, simply because the Visa Bulletin's Dates for Filing is ahead of your priority date does not mean you may "file I-485 now." Unless USCIS permits Dates for Filing, Final Action Dates govern, and you must check the chart USCIS designated for that month.
"If you are not ready in a month when filing is possible, you can miss the opportunity; and moving hastily while unprepared can make the entire case more complicated."
Family availability opened far more than expected heading into the last month of FY2026, and while employment remains favorably Current for Korea, year-end exhaustion warnings are now lit for EB-2 and EB-5 Unreserved. Once the dates move forward they do not necessarily stay there — and because September is the final month of the fiscal year, the situation can change quickly with demand and actual number use. Whether your priority date falls within September's availability, whether you can file I-485 in the U.S., whether a family member has a CSPA issue, and whether Consular Processing or Adjustment of Status is the right path should all be confirmed individually.
