U.S. Work Visas vs. the Green Card —
What Differs, and What Strategy You Need
From H-1B · L-1 · E-2 work visas to EB-1 · EB-2 NIW permanent residence — a U.S. immigration attorney explains the strategy
One of the most common misunderstandings among Koreans planning to work or start a business in the U.S. is the difference between a work visa and the green card. Many assume a work visa naturally converts to permanent residence after a few years. In reality, the two are separate systems with different legal purposes and standards — and holding a work visa does not guarantee a green card.
If your goal is to live in the U.S. long-term, the question is not only "which visa can I get" but "how do I maintain my current status while building toward a green card." This column reviews the three principal work visas, the permanent-residence paths that follow, and the legal issues that actually arise during the transition — grounded in official authority.
01 — The Core Difference
A U.S. work visa is a nonimmigrant visa that lets a foreign national enter or remain in the U.S. for a specific job, investment, or business activity. The green card, by contrast, confers lawful permanent resident (LPR) status, which generally lets you live and work in the U.S. without depending on the sponsoring employer or business a work visa requires.
Even permanent residents, however, can face legal consequences from extended time abroad, certain crimes, or immigration violations. For that reason, obtaining a work visa and applying for a green card are best approached together, within one long-term immigration plan — not as isolated steps.

Specialty Occupation Visa
H-1B is the flagship work visa for foreign nationals in roles that require specialized knowledge and a related degree. It generally requires at least a bachelor's degree or its equivalent in the field, plus a petition filed by a U.S. employer.
Some employers — universities and affiliated nonprofit research institutions, for example — are cap-exempt. The H-1B period is generally six years total, though further extension may be available when a qualifying employment-based green-card process is underway.
Under a rule effective February 27, 2026, the FY2027 registration cycle introduces a wage-level-weighted selection. Higher Department of Labor wage levels receive more entries in the selection (Level IV gets four, Level I gets one), and the method applies to all 85,000 numbers (65,000 + 20,000). The role's wage level and job classification have therefore become far more important.
H-1B petitions also involve entry restrictions and special payment requirements tied to recent presidential proclamations, with related rulemaking and litigation, so you must confirm the rules and exceptions in force at the time of filing.
Intracompany Transferee Visa
L-1 is used when a Korean company opens a U.S. branch or subsidiary, or transfers a manager, executive, or specialized-knowledge employee to an existing U.S. entity. It generally requires at least one continuous year of employment with a qualifying affiliate abroad within the past three years.
For a U.S. new office, the L-1 is typically approved for one year initially; on extension, you must show actual business operations and the ongoing need for the position.
When an L-1A holder applies for an EB-1C green card, the petition must independently satisfy EB-1C's own requirements — the U.S. entity's actual operating record, a qualifying relationship between the U.S. and foreign companies, and the applicant's managerial or executive duties. L-1A approval does not automatically secure EB-1C approval.
Treaty Investor Visa
E-2 is for nationals of a treaty country who invest substantial capital in a U.S. enterprise and come to develop and direct it. Korean nationals can qualify under the treaty.
E-2 has no fixed statutory minimum. "Substantiality" is judged in proportion to the nature of the business and its total cost. The funds must be genuinely at risk, and the enterprise must be a real, operating, for-profit business — not a marginal enterprise that merely supports the investor and family.
E-2 can be extended as long as the requirements hold, but it does not, on its own, convert into a green card. Nor is it a dual-intent visa in the way H-1B and L-1 are. That said, merely planning a future green-card application or having an immigrant petition pending does not automatically end E-2 eligibility in every case. Maintenance of status, intent to depart, consular review, and adjustment eligibility must all be weighed on the specific facts.
03 — Paths to the Green Card
Extraordinary Ability
EB-1A is the employment-based category for those who can demonstrate extraordinary ability in the sciences, arts, education, business, or athletics. It allows a self-petition — no U.S. employer sponsor required.
Absent a major internationally recognized award, you generally must meet at least three of ten regulatory criteria. But merely meeting three does not guarantee approval. Through a Final Merits Determination, USCIS assesses whether the applicant has sustained national or international acclaim and sits among the small percentage at the very top of the field — the framework confirmed in Kazarian v. USCIS, 596 F.3d 1115 (9th Cir. 2010).
EB-1C
Researchers & Multinational Managers
EB-1B is for qualifying outstanding professors and researchers and requires a petition from a qualifying U.S. employer. EB-1C is the permanent-residence category for multinational managers and executives.
EB-1C is often a strong option for an L-1A holder transferred from a Korean parent to a U.S. affiliate — but the petitioning U.S. company's operating history, the corporate relationship, and the applicant's role are all examined independently.
NIW
National Interest Waiver
The EB-2 National Interest Waiver (NIW) lets an advanced-degree professional or a person of exceptional ability ask USCIS to waive the usual job offer and labor certification (PERM) requirements based on their contribution to the national interest. Crucially, the applicant can file the I-140 petition directly, without an employer sponsor.
Matter of Dhanasar, 26 I&N Dec. 884 (AAO 2016)에 따른 세 가지 요건을 입증해야 합니다.NIW first requires meeting the underlying EB-2 criteria, then proving the three prongs of Matter of Dhanasar, 26 I&N Dec. 884 (AAO 2016).
Substantial merit & national importance
The proposed endeavor has both substantial merit and national importance.
Well positioned to advance it
The applicant is well positioned to advance that endeavor.
On balance, beneficial to waive
On balance, it would benefit the U.S. to waive the job offer and labor certification.
Notably, 2025 USCIS policy guidance emphasizes not just credentials but the specificity of the planned endeavor, its national importance, and the real persuasive weight of the evidence. A generic claim that one will "start a business or create jobs" does not automatically establish national importance; research output, industry contribution, business track record, objective expert assessment, and feasibility are all weighed together.
04 — Legal Issues in the Transition
How far your current visa allows immigrant intent
H-1B and L-1 are the principal dual-intent visas. E-2, by contrast, carries its own intent-to-depart consideration, so the interplay between a green-card process and maintaining E-2 status must be handled carefully.
Petition approval is not the green card
Even after I-140 approval, visa availability turns on the State Department Visa Bulletin. To adjust status inside the U.S., you must also meet the chart USCIS designates for that month and your own eligibility.
Consistency across visa and petition records
Material discrepancies in job duties, work history, corporate structure, or financials can trigger a Request for Evidence or credibility concerns.
Starting a petition does not grant status or work authorization
Filing an I-140 or beginning the green-card process does not, by itself, confer lawful status or work authorization. To adjust status within the U.S., you must review your status, any unauthorized employment, adjustment eligibility, and travel plans together.

What matters in U.S. immigration is not simply getting a visa approved, but weighing your current status and your long-term green-card prospects at the same time. A professional joining a U.S. company, an executive expanding a Korean business, an investor running a U.S. enterprise, and a researcher or technical specialist may each need a different strategy.
A work visa creates the opportunity to act in the U.S.; the green card is an immigrant status earned through a separate set of requirements and procedures. Two different systems — understood correctly, planned early.
Understanding both systems accurately and designing the right path from the earliest stage helps reduce unnecessary delay and legal risk.
A visa approval and a green card are separate decisions. The question is not only which visa you can get, but which green-card path that visa can lead to — planned together from the start.
