Green Card & Re-entry Permit —
30 Questions You Should Ask
Q&A Will six months in Korea cost you your green card? From the re-entry permit to citizenship — a maintenance Q&A by attorney Chris W. Chong
Even after obtaining a U.S. green card, many need to care for parents, work, or run a business in Korea. For those who live between the two countries, one of the biggest questions is how to keep that green card.
If I stay in Korea more than six months, do I lose my green card?
With a re-entry permit, can I live in Korea for two years?
I stayed long with no permit — can I still enter the U.S.?
Can I keep status by briefly entering every six months?
The answers are not decided by time abroad alone. U.S. immigration law weighs the length of absence together with your intent to reside permanently in the U.S., your actual ties, and the travel document needed to return.

(2026. 10. 7.)New I-131 Filing Address (Oct 7, 2026)
USCIS changed the mailing address for Form I-131. Using an old address or outdated guidance can cause delays or rejection, so confirm the current filing address before you file.
Advance Parole 출국 위험 (BIA, 2026. 8.)Advance Parole Travel Risk (BIA, Aug 2026)
(영주권자의 재입국허가서와는 별개 — Q29 참고)Under the BIA's Matter of Delcarmen-Lara, prior case law changed: Advance Parole travel after 180+ days of unlawful presence can now trigger the 3- or 10-year bar. (Separate from an LPR's re-entry permit — see Q29.)
This column reflects these latest changes and walks through 30 questions on status maintenance, re-entry permits, biometrics, long absences, admission, and naturalization.
5 Parts · 30 Questions
The Green Card and Time Spent in Korea
No. Being abroad for more than six months does not, by itself, automatically cancel your green card.
However, INA §101(a)(13)(C) provides that after a continuous absence of more than 180 days, you may be treated as an "applicant for admission" on return. That does not mean the card is lost automatically — it affects your legal posture and the scope of review at inspection. Whether you kept the intent to reside permanently is also key.
Generally, after a continuous absence of a year or more, the green card alone no longer satisfies the ordinary travel-document requirement. If you plan a long stay, apply for a re-entry permit before leaving. If you are already abroad over a year with no permit, consider options such as a Returning Resident Visa (SB-1).
That said, passing one year does not automatically end your status.
Not necessarily. Suppose you repeatedly spend five months in Korea, visit the U.S. for a week, and return. Even with many entries, if your home, family, job, and economic center are in Korea, abandonment can become an issue.
What matters is not the number of entries, but the intent to keep the U.S. as your permanent home — and the ties that show it.
An ordinary short visit usually poses little problem. But if you have wound down your U.S. home and job and effectively relocated to Korea, even a short absence can raise an issue.
So time abroad alone cannot determine whether you are safe.
There is no blanket "live in the U.S. at least six months a year" rule for every green card holder. But the principle that the U.S. must remain your permanent home applies.
Naturalization separately requires continuous residence and physical presence. Keeping the card and obtaining citizenship must be analyzed separately.
It may be possible, but calls for caution. If, right after getting the card, you live long in Korea without establishing a real U.S. base, your intent to reside permanently can be questioned.
So even a new green card holder planning a long stay should check the need for a re-entry permit before departure.
(Re-entry Permit)The Re-entry Permit
A re-entry permit is a travel document for green card holders planning a long absence. It is generally valid for up to two years from issuance and provides important protection against a finding of abandonment based solely on time abroad.
But it does not waive all grounds of inadmissibility or unconditionally guarantee re-entry.
No. Exceeding six months does not make a permit mandatory. Generally, after an absence of less than one year, you may return with a valid green card.
Still, if the absence may be repeated or prolonged, consider applying before you leave.
A permit valid up to two years is a useful travel document for a long absence. But holding one does not waive inspection or other immigration requirements.
In particular, a permit does not protect the continuous-residence requirement for naturalization. So manage your U.S. ties and your citizenship plan separately.
As a rule, no. An applicant must be physically present in the U.S. at the time of a proper filing — a requirement under 8 CFR §223.2(b)(1) and the USCIS Form I-131 instructions.
Preparing documents in Korea, or mailing them through U.S. family, does not satisfy the presence requirement.
Yes. USCIS announced a change to the mailing (direct filing) address for Form I-131, effective October 7, 2026. Applicants must confirm the current address for their filing type.
Per the notice, a 30-day grace period applies: filings postmarked on or before November 9, 2026 sent to the previous address are still accepted. Even so, continuing to use the old address is not advisable.
In particular, permanent residents who must file while in the U.S. should verify the current address right before submitting to avoid delay or rejection.
Confirm: https://www.uscis.gov/i-131-addresses
There is no general waiting period requiring weeks of residence before filing. If you file properly while physically in the U.S., you may depart before approval — but if USCIS requires biometrics, you must complete it in the U.S.
Also, the mailing date and the date of a proper receipt can differ, so confirm a filing moment that meets the presence requirement. The USCIS Administrative Appeals Office (AAO) has upheld denials where the application was received while the applicant was outside the U.S.
So a plan to depart immediately after mailing should be reviewed with counsel in advance.
Biometrics and the Filing Process
If USCIS requires biometrics, you must comply. For some, prior biometrics may be reused or appearance waived — but not automatically, so check your individual USCIS notice.
There is no fixed timing — it varies with USCIS volume, workload, and the case. So you should not assume it finishes within two or three weeks. If your Korea departure is fixed, leave ample lead time.
Departure itself is not an automatic denial. But failing to appear for required biometrics can lead to denial. If you receive the notice after leaving, you may need to return to the U.S. to complete it.
With good cause, you may request a reschedule via your USCIS online account or the Contact Center. But you cannot freely pick any date.
In particular, for travel-related requests, apply before the scheduled date, following current USCIS procedures.
Yes. After a proper U.S. filing, you may request overseas delivery and collect the approved permit at a designated U.S. embassy, consulate, or DHS overseas office.
But collecting it in Korea and applying from Korea are entirely different. The application itself must be made properly within the U.S.
An existing permit cannot simply be extended. A new one generally requires entering the U.S. and meeting the filing requirements again.
Also, measured over the last five years (or since becoming a permanent resident, whichever is shorter), someone abroad more than four years in the aggregate may receive a permit limited to one year (with statutory exceptions). Review your prior travel history before filing.
Re-entry and Keeping Your Status
No. Even with a valid permit, you must undergo CBP inspection. Officers may review identity, grounds of inadmissibility, and other requirements. A permit does not waive inspection.
First review your status, the length of the stay, why you left, and your return plan. If requirements are met, consider a Returning Resident Visa (SB-1) through a U.S. embassy or consulate. SB-1 requires showing you kept the intent to reside and that the delay was due to reasons beyond your control.
Depending on the facts, other travel documents or procedures may be available. Do not decide to abandon your status just because you were abroad over a year.
It is possible. Caring for a parent can be an important reason explaining a long absence — but that alone does not automatically guarantee maintenance of status.
Medical records, treatment history, the actual caregiving period, your U.S. home and family ties, and your return plan are weighed together.
Working or running a business in Korea does not, by itself, cost you status. But if you reside there long and move your family, home, job, and economic center to Korea, it can weigh against your intent to reside in the U.S.
Those planning a Korea business or a long assignment should review both a re-entry permit and maintaining U.S. ties together.
Not a guarantee, but strong evidence. A U.S. home, family, employment, banking, and tax records show ongoing ties — yet a nominal address or tax filing alone does not establish intent.
In particular, filing taxes as a nonresident can be an adverse factor under immigration law — take care.
If you do not intend to give up your status, think carefully before signing Form I-407 — the form for voluntary abandonment. Even if an officer raises it, you need not agree to abandon it on the spot.
When abandonment is disputed, a process before the immigration court may be available. So get an immigration attorney's advice before signing if at all possible.
Signing I-407 can be read as a voluntary abandonment of your green card. If that is not your intent, decline to sign, clearly state your intent to keep your status, and consult an immigration attorney as soon as possible.
Citizenship and Key 2026 Changes
No. Keeping status and naturalization are separate. Even with a permit, a continuous absence of more than six months but under a year can create a presumption that continuous residence was broken.
An absence of one year or more breaks continuous residence absent a statutory exception. A permit does not automatically preserve the continuous-residence or physical-presence requirements for naturalization.
A general applicant must meet requirements including:
5 years of continuous residence as a permanent resident
At least 30 months of physical presence within those 5 years
A qualifying spouse of a U.S. citizen may use 3 years of continuous residence and 18 months of physical presence. Additional requirements apply — jurisdiction of residence, the English/civics tests, and good moral character.
Generally, a continuous absence of a year or more breaks continuous residence for naturalization. But the green card itself is not automatically invalidated.
Under the 5-year rule, you may consider filing once 4 years and 1 day have passed since return. But filing then can re-trigger the break-in-residence presumption due to the earlier absence, so depending on the facts you may need to wait about 4 years and 6 months.
The 3-year rule for spouses is calculated differently, so the same period should not be applied to everyone. The precise earliest filing date must be determined from your travel history and applicable exceptions.
Assignees expecting a long stay abroad should also assess a re-entry permit. Employees of certain qualifying U.S. companies/organizations may use Form N-470 to preserve continuous residence for naturalization.
But it does not apply to every assignee, and N-470 differs from a re-entry permit in purpose and requirements, so review each separately.
Matter of Arrabally and Yerrabelly The BIA's Matter of Delcarmen-Lara, issued August 13, 2026, primarily addresses travel on Advance Parole and the unlawful-presence bars, overruling Matter of Arrabally and Yerrabelly.
새 기준에 따르면 Advance Parole을 이용한 출국도 INA §212(a)(9)(B)(i)에 따른 '출국'으로 인정될 수 있습니다. Under the new standard, travel on Advance Parole can count as a "departure" under INA §212(a)(9)(B)(i). So some non-LPRs with over 180 days of unlawful presence may face the 3- or 10-year bar even with Advance Parole.
However, this decision did not change the LPR re-entry permit itself. Both are filed on Form I-131, but they have different subjects and legal purposes. Adjustment applicants holding Advance Parole should carefully review unlawful-presence history and inadmissibility before departure.
Matter of Delcarmen-Lara, 29 I&N Dec. 830 (BIA 2026). Note: Matter of Delcarmen-Lara, 29 I&N Dec. 830 (BIA 2026). The decision applies the new rule prospectively, so prior departures need separate analysis.
The most important step is to review your status and plans before you leave. In particular, check:
The purpose and expected length of the Korea stay
Your U.S. travel history over the last five years
Your U.S. home and family ties
U.S. employment/business and tax-filing status
Whether a re-entry permit is needed
The current Form I-131 filing address and biometrics timing
The permit's expiry and overseas pickup options
Your future naturalization plan
In particular, since the I-131 mailing address changed in October 2026, do not rely on a previously used address or outdated online guidance.
A green card is not kept merely by entering every six months or getting a permit. The intent to keep the U.S. as your permanent home — and real ties — are what matter.
Caregiving, a business, a work assignment, a child's schooling — a long absence can be unavoidable. But those reasons do not automatically waive the maintenance requirements.
In 2026, with the I-131 address change and a major Advance Parole ruling, it has become even more important to pin down your exact immigration status and the type of travel document you use. The re-entry permit is an important safeguard — but it does not guarantee re-entry or citizenship.
The core of keeping a green card is not how often you entered — it is whether you kept the U.S. as your permanent home.
