미국에 진출하는 한국 기업들이 가장 자주 하는 질문 중 하나가 있다. “한국 본사 직원이 잠깐 미국에 가서 일을 도와주는 것인데, ESTA로 가면 안 됩니까?”

One question Korean companies entering the U.S. ask most often: “A headquarters employee is just going to the U.S. to help out briefly — can’t they just use ESTA?”

최근 한미 조선산업 협력의 핵심 프로젝트인 MASGA(Make American Shipbuilding Great Again)에서도 이와 비슷한 문제가 수면 위로 떠올랐다. 2026년 7월 23일 한국 산업통상부와 미국 상무부는 워싱턴 D.C.에 한미조선협력센터(KUSPC)를 공식 출범시켰다.

The issue recently surfaced in MASGA (Make American Shipbuilding Great Again), a flagship Korea–U.S. shipbuilding project. On July 23, 2026, Korea’s Ministry of Trade and the U.S. Department of Commerce launched the Korea–U.S. Shipbuilding Partnership Center (KUSPC) in Washington, D.C.

대한민국 국민은 Visa Waiver Program(VWP)에 따라 ESTA 승인을 받고 일반적으로 최대 90일까지 미국을 방문할 수 있다. 하지만 여기서 가장 흔한 오해가 발생한다. ESTA로 입국할 수 있다는 사실과 미국에서 일을 할 수 있다는 것은 전혀 다른 문제다.

Korean nationals can visit the U.S. — generally up to 90 days — with ESTA approval under the Visa Waiver Program (VWP). Here lies the most common misunderstanding: being able to enter on ESTA is entirely different from being allowed to work.

미 국무부는 이 부분을 명확히 설명한다. ESTA 비즈니스 방문자가 할 수 있는 활동의 범위는 기본적으로 B-1 비즈니스 방문자에게 허용되는 활동과 같다. 반면 employment, 즉 미국에서의 취업·근무는 VWP로 허용되지 않는다.

The State Department is clear: an ESTA business visitor’s permissible activities are essentially the same as those allowed for a B-1 business visitor. But employment — working in the U.S. — is not permitted under the VWP.

미 국무부의 Foreign Affairs Manual과 공식 B-1 가이드라인에 따르면, 일반적으로 다음 활동은 비즈니스 방문의 범위에 들어갈 수 있다. 반대로 미국 사무실에 매일 출근해 일상 업무를 수행하거나, 현장에서 생산·설치·관리를 직접 하거나, 미국 법인의 인력 부족을 메우려 실제 업무를 맡는다면 문제는 전혀 달라진다. 국무부는 B-1이 원칙적으로 skilled or unskilled labor의 수행과 미국 내 employment를 허용하지 않는다고 명시한다.

Under the Foreign Affairs Manual and official B-1 guidance, the activities below generally fall within a business visit. By contrast, reporting to a U.S. office daily for routine operations, performing hands-on production/installation/management, or filling a staffing gap at the U.S. entity changes everything. The State Department states B-1 generally does not allow skilled or unskilled labor or U.S. employment.

기업들이 특히 많이 오해하는 부분이다. 한국 본사가 급여를 지급하고 미국 법인에서 월급을 받지 않으면 ESTA·B-1으로 자유롭게 일할 수 있다고 생각하는 경우가 있다. 그렇지 않다. 미국에서 급여를 받지 않는다는 사실은 중요한 요소이지만, 그것만으로 허용되는 활동이 되는 것은 아니다.

A frequent misconception: that if Korea HQ pays the salary and the U.S. entity pays nothing, one can freely work on ESTA/B-1. Not so. No U.S. salary is a meaningful factor, but it alone does not make an activity permissible.

전통적인 B-1 판단의 핵심 기준 중 하나는 주된 사업활동과 수익 발생의 중심이 해외에 있고, 미국 내 활동이 그 해외 사업에 부수적인지 여부다. 따라서 한국 본사에서 급여를 받는 직원이라도 미국에서 수개월간 미국 법인의 정상 운영업무를 맡는다면 단순 출장이라 단정하기 어렵다. 결국 급여의 출처와 함께 업무의 성격·장소·기간·목적을 전체적으로 판단해야 한다.

A classic B-1 test is whether the principal place of business and the accrual of profits remain abroad, with the U.S. activity incidental to that foreign business. So even an HQ-paid employee running normal U.S.-entity operations for months is hard to call a mere trip. The source of pay must be weighed together with the nature, place, duration, and purpose of the work.

엔지니어와 기술자는 조금 다르다Engineers and Technicians Are a Special Case

한국에서 제작한 산업용 장비를 미국 공장에 판매한 뒤, 그 장비의 설치·정비 또는 미국 직원 교육을 위해 한국 기술자가 미국에 들어가는 상황을 생각해 보자. 미 국무부는 일정 요건을 충족하는 경우 이러한 경우에 대한 구체적 예외를 두고 있다.

Consider a Korean maker that sold industrial equipment to a U.S. plant and now sends a technician to install/service it or train U.S. staff. The State Department provides specific exceptions where certain requirements are met.

Where installation/service/repair of equipment sold by the foreign firm — or related training of U.S. staff — is required by contract, the worker has the specialized knowledge needed, and receives no U.S. salary.

해외에서 공급된 산업장비·공정 등에 관한 특수하고 독점적인 기술을 미국 직원에게 이전·교육하기 위해 일시 방문하는 경우, 일정 요건하에 B-1을 인정할 수 있으며 비자에 “B-1 SPECIALIZED TRAINER”라고 표시하도록 한다.

For temporary visits to transfer or train U.S. employees on specialized, proprietary techniques for foreign-supplied equipment/processes, B-1 may be allowed under set conditions and is annotated “B-1 SPECIALIZED TRAINER.”

중요한 제한 — 건설공사는 제외A Key Limit — Construction Is Excluded

특히 건설공사(building or construction work)를 직접 수행하는 것은 이 예외에 포함되지 않는다. 다만 실제 공사를 직접 하지 않고 현지 직원을 감독·교육하는 경우에는 사안에 따라 B-1 가능성을 검토할 수 있다. 따라서 반도체·배터리·자동차·조선·자동화 기업이 엔지니어를 파견할 때는 “기술지원이니까 ESTA 가능”이라고 단정하지 말고, 계약 내용과 현장 실제 업무를 먼저 분석해야 한다.

Notably, performing building or construction work is not within this exception. But supervising or training local staff — without doing the construction itself — may be reviewable for B-1 depending on facts. So before sending engineers, semiconductor / battery / auto / shipbuilding / automation firms should analyze the contract and the actual on-site duties — not assume “it’s tech support, so ESTA works.”

한미조선협력센터는 단순 홍보 사무소가 아니다. 한국 정부 설명에 따르면 KUSPC는 미국 조선소 생산성 컨설팅, 전문인력 교육, 기술교류, 공동 R&D, 투자 프로젝트를 추진하고 한국 기업의 미국 조선시장 진출을 지원한다. MASGA가 실제 투자 단계로 확대될수록 미국으로 이동할 인력도 늘어난다 — 조선소 운영 전문가, 스마트팩토리·자동화·로봇 엔지니어, 선박설계·품질관리·PM·경영진 등.

KUSPC is not a mere PR office. Per Korea’s government, it pursues productivity consulting, workforce training, technology exchange, joint R&D, and investment projects for U.S. yards and supports Korean firms’ entry. As MASGA scales into actual investment, more people must move — yard-operations experts, smart-factory/automation/robotics engineers, ship designers, QA, PMs, executives.

문제는 미국 이민법에 “MASGA 프로젝트 전용 비자”가 없다는 것이다. 양국 정부가 전략산업 협력을 추진한다는 사실과, 개별 외국인의 미국 취업자격은 별개의 법률문제다. 실제 파견인력에게는 업무와 기업구조에 따라 다음 카테고리를 검토해야 할 수 있다.

The problem: there is no “MASGA visa.” That two governments pursue strategic cooperation and whether an individual may work in the U.S. are separate legal questions. Depending on role and corporate structure, these categories may need review:

ESTA approval does not guarantee entry. It pre-authorizes boarding a U.S.-bound flight; actual admission is decided by CBP at the port of entry. So frequent short-interval visits, repeated long stays, or a pattern of effectively regular work at a U.S. office can trigger sharper questioning about the purpose of travel.
