If I develop dementia, who manages the money in my bank account? Before anything passes to my children, how is my own care and living covered?

Estate planning is not only about what happens after death. Managing your assets safely and using them for yourself while you are alive comes first. Here we compare Korea's will-substitute trust and the U.S. Revocable Living Trust in plain language, based on statutes and official sources.

If I develop dementia, who manages the money in my bank account?

If medical bills pile up and I have to sell my house, who handles that for me?

I want to leave assets to my children, but while I'm alive I want them used first for my own care and living.

In estate-planning consultations here in the U.S., I often meet people with exactly these practical worries. They worked hard their whole lives to buy a home, save for retirement, and raise their children — yet many are not fully prepared for the day they fall seriously ill or can no longer manage their own assets.

When we hear the word "inheritance," we usually think first of children dividing assets after a parent dies. But estate planning poses an earlier question: "While I am alive, how will I keep my assets safe and use them for myself when I need to?" In Korea, the will-substitute trust has emerged as one answer; in the U.S., the living trust plays a similar role. The two work differently, but they share a purpose: to go beyond simply passing assets to children and help you manage and use your assets deliberately while you are still alive.

1Korea's will-substitute trust — planning ahead for care and living costs

Consider a hypothetical 70-year-old woman, Ms. A, living in Korea. After losing her husband, she lives alone; her assets are a single apartment in her name and some bank savings. One day she is diagnosed with a serious illness. The immediate treatment cost is a worry, but if she needs years of hospital visits or a caregiver, even living expenses become a heavy burden. The bigger concern is the day her health declines and she can no longer handle banking or sell real estate herself.

One option Ms. A can consider is a will-substitute trust. Through a trust contract, it links lifetime asset management with post-death succession. For example, in her contract with a trustee such as a bank, Ms. A can set terms like these:

  • While healthy, trust assets are used for her living expenses.
  • If illness brings treatment or caregiving costs, they are paid under the contract.
  • If she can no longer manage her assets, the trustee manages the trust property.
  • If needed, real estate is sold under set terms and procedures to fund care.
  • After death, the remaining assets pass to her designated children.
⚠ IT DEPENDS ON THE CONTRACT Not every will-substitute trust provides these features automatically. What the trustee may actually do, and any power to dispose of real estate, depend on the terms of the trust contract.

Korea's Trust Act Article 59 sets out the legal structure of a will-substitute trust, under which a beneficiary acquires rights upon the settlor's death, or receives benefits from the trust property after death. The key point is that a trust is not merely a way to store assets. It can serve as a tool to manage assets for yourself while you are alive, and to transfer the remainder to the people you choose after death. So how can such a plan be built in the U.S.?

2The U.S. living trust — an estate plan that works while you're alive

The U.S. has the Revocable Living Trust. The name sounds technical, but the idea is fairly simple: you place assets you own — a home, financial accounts and the like — into a trust, and decide in advance who manages them, and when and for whom they are used.

Suppose a Korean American couple in their 70s owns a home, bank savings, and an investment account. While healthy, they want to handle their own banking and manage their assets; later, if dementia or serious illness makes that hard, they want a trusted child to manage things for them. And after both pass away, they want the remainder divided fairly among their children. A living trust lets them design lifetime management and after-death distribution together.

In a typical living trust, the person who created it serves as trustee during life and keeps managing the assets. If they lose the capacity to manage, the successor trustee named in the trust takes over under set procedures. California's official conservatorship handbook likewise explains that a properly drafted living trust naming a successor trustee can be designed so that, when you can no longer manage your assets, trust management continues without a separate court conservatorship. Reducing this gap in asset management is a central benefit of the U.S. living trust.

U.S. trust law varies by state, but a Revocable Living Trust basically means a trust in which the settlor keeps the power to amend or revoke it during life. So it's hard to say either system is categorically better.

What truly matters is not which system wins, but defining concretely who manages the assets, what happens if you lose capacity, and who receives the assets after death.

4What goes wrong in the U.S. when dementia or serious illness strikes?

There's one thing Korean Americans preparing for later life should especially note: owning assets and being able to actually use them are two different things. Suppose you own a home worth $800,000 and substantial savings in your name — outwardly, a secure retirement. But what happens when dementia worsens and you can no longer handle banking yourself?

Merely having a spouse or adult children does not automatically grant them legal authority to freely manage all your assets. Depending on how accounts are titled, whether a power of attorney exists, and the legal authority involved, family members may find it hard to handle banking or real-estate transactions — and without proper agency or a trust, a court conservatorship may become necessary.

To prepare, people in the U.S. often pair a living trust with a Durable Financial Power of Attorney. The trust manages assets funded into it, while the power of attorney covers assets outside the trust and other legal and financial matters.

⚠ ASSET POWER ≠ MEDICAL DECISIONS A successor trustee's power to manage assets does not include authority to make medical treatment decisions. For that, a separate healthcare power of attorney or advance directive may be needed. U.S. estate planning is not just drafting inheritance papers — it's building legal safeguards against unexpected illness and loss of capacity.

5“Medicare covers long-term care, right?” What you must know

One of the most common misunderstandings in U.S. retirement planning is the scope of Medicare coverage. Many assume that enrolling in Medicare at 65 covers most nursing-home and long-term care costs. The reality is different.

Medicare may cover short-term skilled nursing and rehabilitation where medically necessary, but it generally does not cover long-term custodial care — help with daily activities like bathing, eating, and dressing. The official Medicare guidance states this limit clearly.

For example, if dementia requires years in a care facility or an ongoing in-home caregiver, you may have to pay a substantial amount yourself. That burden falls on retirement savings built over many years — and it's harder for families whose wealth is concentrated in a home rather than cash, because they may own a house yet lack the cash on hand for care.

To prepare, a living trust can specify in advance how living and care costs are paid, any power to sell real estate, and the manager's responsibilities. But a trust is not insurance that pays medical bills. Its role is not to eliminate costs, but to make sure your assets can be properly managed and used when you need them.

6Does putting your home in a living trust shield it from the government?

There's a misconception about living trusts that must be corrected.

If I put my house in a trust, is it safe from nursing-home costs?

Does creating a living trust make me eligible for Medicaid?

To be clear: an ordinary Revocable Living Trust does not produce these effects automatically. Medicaid is a government program providing medical and long-term care services to those who meet certain requirements, and eligibility review examines income, assets, and asset-transfer history.

⚠ 42 U.S.C. §1396p(d)(3)(A) Under federal law, assets in a revocable trust are generally treated as an available resource in Medicaid eligibility review. So transferring your home into an ordinary living trust does not automatically exclude it from the asset test or fully shield it from government cost recovery.

Some families consider a separate irrevocable trust. But even then, you must weigh the trust's payment terms, the timing of asset transfers, the rights you retain, and Medicaid's general five-year look-back period on transfers. Moreover, Medicaid operates an Estate Recovery program that, under certain conditions, recovers long-term care costs from a recipient's estate after death — though statutory limits and exceptions (for example, a surviving spouse or certain children) may apply.

So in U.S. estate planning you must distinguish living-trust management and inheritance planning from Medicaid eligibility and asset-protection planning. This is a key reason many Korean American families should obtain legal review in advance.

7Is a will alone enough in the U.S.?

Some people think that drafting a single will solves everything. But a will and a living trust play different roles. A will is fundamentally a document expressing your wishes for distributing assets after death, whereas a living trust is effective while you are alive and can be designed to continue managing your assets.

Also, assets passing under a will may have to go through probate — the court's estate administration — depending on asset type, title, and state law. By contrast, assets properly funded into a trust can generally be managed and distributed under the trust terms after death without separate probate (though creditor claims, taxes, real-estate title issues, and trust disputes may still need to be resolved).

⚠ DON'T FORGET TRUST FUNDING Creating a living trust does not automatically place all assets in your name into it. A home may need a proper deed transfer, and bank/investment accounts may need to be retitled into the trust through the institution's process. If you make the trust document but never fund it, the intended effect may not fully occur.

So a comprehensive U.S. estate plan may include not only a living trust but also a will, a financial power of attorney, healthcare directives, and a review of beneficiary designations.

In many long-settled Korean American families, parents live in the U.S. while children live in another state or in Korea. Conversely, some residents of the U.S. hold real estate or financial assets in Korea. For such families, considering only one country's inheritance system may not be enough.

For example, even if you set up a living trust in the U.S., you must separately examine whether an apartment in Korea can be validly funded into that trust, and what documents Korean financial institutions or property registries require. And between U.S. citizens, permanent residents, and Korean nationals, different legal considerations can arise for estate/gift tax, asset transfers, and cross-border inheritance.

A trust is very useful, but it is not recognized identically, or taxed identically, in every country. If your assets span the U.S. and Korea, it's important to review together which assets are where, who the beneficiaries are, and which laws apply during life and after death.

9Estate planning is for the living you — not just for after you're gone

In these consultations, parents say much the same thing: “I don't have much, but I don't want to be a burden to my children.” I understand that feeling completely. But I believe it helps to shift how we view estate planning.

If it's wealth a parent built over a lifetime, it should first be available for that parent's own secure and dignified later years: proper treatment when health declines, caregiving when needed, and stability in daily life. Passing the remainder to children afterward can be a more realistic and balanced plan. That is exactly the message of Korea's will-substitute trust and the U.S. living trust.

Even with just a home and some savings in the U.S., such planning is worth reviewing. A trust is not required for everyone, though — depending on the size and titling of assets and family circumstances, a simpler approach may be appropriate. What matters is not how much you have, but knowing what risks you face and what to prepare.

While you are healthy and have full capacity today, name a trusted asset manager, set how care and living costs are paid, and arrange how assets will pass to family. After illness or an accident makes decisions hard, building or changing such a plan becomes far more difficult. A good estate plan starts not with how much you'll leave your children, but with how stable and dignified your own life can be while you're alive.

More important than leaving assets behind is preparing so that, when the moment comes, they can be properly used for you and your family.
