You created a trust — but what if your assets were never in it?
What your Living Trust needs in order to actually work in 2026
Does simply creating a Living Trust automatically protect your assets? And if you have a will, why might your estate still go through the court (Probate)?
Many people assume that signing their trust documents means their estate planning is complete. But in real estate-settlement cases, the issue that comes up most often lies elsewhere — Trust Funding. Below we explain the difference between a will, a Living Trust, and an overall estate plan, along with the most common mistake, based on government and statutory sources.
If I just make a will, will my assets automatically pass to my children?
Do I really need a Living Trust if I only own one home?
If I set up a trust, will it reduce estate tax and also let my family avoid court?
If you are a Korean American who has lived in the U.S. for many years, these are questions you have probably considered at least once. As home values rise and more families prepare for retirement, interest in how to pass one's assets to a spouse and children continues to grow.
Yet many people think of Estate Planning, a Will, and a Trust as roughly the same thing. These three are closely related, but they serve legally distinct roles. If you don't understand the difference accurately, you can spend a significant amount setting up a trust and still leave your family to go through a separate court process. Let's look at this based on the U.S. estate system and federal estate tax rules as they stand in 2026.
1Estate planning is not simply about passing on assets
Estate planning means more than deciding who will inherit your assets after death. It is a comprehensive legal plan that also addresses who will manage your property and make medical decisions if you lose decision-making capacity due to illness or accident while alive, and who will settle debts and taxes and distribute the remaining assets after death. The following documents are commonly used.
|---|---|
| 유언장Last Will and Testament | 사망 후 재산 분배 및 유산 집행자 지정, 미성년 자녀의 후견인 추천 |
| Legal Document | Primary Role |
|---|---|
| Last Will & Testament | Distributes assets after death, names an executor, and recommends a guardian for minor children |
| Revocable Living Trust | Manages trust assets during life and after death and distributes them to beneficiaries |
| Durable Power of Attorney | Lets a designated agent handle property and financial matters when you cannot |
| Advance Healthcare Directive | Provides instructions for medical decisions and treatment preferences |
| Beneficiary Designation | Transfers assets to named beneficiaries on life insurance, retirement accounts, and the like |
2What exactly is a Living Trust?
One of the most widely used estate planning tools in the U.S. is the Revocable Living Trust. A trust establishes a legal structure for owning and managing property, and generally three parties play key roles.
The person who creates the trust and transfers assets into it
The person who manages the assets under the trust document
The person who receives benefits and distributions from the trust
In a revocable living trust, the same person is often the settlor, the initial trustee, and the lifetime beneficiary. For example, a parent may transfer a home into a living trust, name themselves as initial trustee, and provide that after death an adult child will serve as successor trustee to manage the property. Under this structure, the parent generally can continue to use and dispose of the home while alive (within the conditions set by the trust document and the law). A revocable trust can also be amended or revoked, subject to its terms, while the settlor has capacity.
Creating a trust does not automatically place all of your assets into it
이를 Trust Funding(신탁재산 편입)이라고 합니다.
This point is critically important in actual estate cases. Even if you have signed the living trust document, if you have not completed the necessary steps — such as transferring title to your home — that home may not be included in the trust estate. This is called Trust Funding.
3The biggest difference between a will and a trust is probate
Probate is the legal process of settling a deceased person's estate. Where required, the court confirms the validity of the will, appoints an estate administrator, and oversees the settlement of debts and taxes and the distribution of property. However, having a will does not automatically exempt an estate from probate. In fact, a court process may be needed in order to distribute assets according to the will.
Conversely, a properly established and funded living trust can help avoid the ordinary probate process for the transfer of those trust assets. That said, the mere existence of a trust does not make every court process and legal obligation disappear. Court involvement may still be needed if assets remain outside the trust, if there is a dispute among heirs, or if the validity of the trust itself is challenged. Even for trust assets, creditor claims, tax filings, and the trustee's accounting and fiduciary duties must be addressed separately.
4If I have a trust, do I still need a will?
대표적인 문서가 Pour-Over Will(잔여재산을 신탁으로 이전하도록 하는 유언장)입니다.
In most comprehensive trust-based estate plans, it is advisable to also prepare a will. A representative example is a Pour-Over Will. This is a will that directs any estate still held in your individual name — and not funded into the trust — at the time of death to be transferred into the trust through the required legal process.
For example, suppose you created a living trust, later opened a new financial account, and died without having funded it into the trust. A Pour-Over Will can help ultimately direct that asset into the trust, but it does not mean the asset necessarily transfers without probate. Depending on the type and size of the asset and the applicable state law, a court process may be required. If you have minor children, naming a guardian through a will is also an important consideration (final appointment rests with the court under applicable law).
5How do the 2026 inheritance laws of California, Utah, and Texas differ?
U.S. estate tax is affected by federal tax law, but probate and property-transfer procedures vary by state law. If you hold a home or financial assets in California, Utah, or Texas, you need to review each state's laws separately. Representative small-estate thresholds are as follows.
California — Certain homes transfer through a simplified process
Under the threshold effective April 1, 2025, the general small-estate personal property limit was adjusted to $208,850. In addition, for a decedent's California primary residence meeting certain requirements, a simplified court petition process is available based on a value threshold of $750,000 or less (California Probate Code §§13150–13157 and related provisions). However, being $750,000 or less does not automatically exempt every procedure; you must confirm the nature of the property, the composition of the rest of the estate, and the petition and notice requirements. So owning a home does not necessarily mean you need a living trust, but a trust may be more suitable if you own multiple properties, have many beneficiaries, or need long-term asset management.
Utah — Whether real property is involved is a key factor
A Small Estate Affidavit may be used for a qualifying small estate under $100,000. Typical requirements are a total estate under $100,000, no real property involved, 30 days elapsed since death, and no pending application to appoint a personal representative (Utah Code §75-3-1201). Accordingly, when a person who owned a home in their individual name dies, the small-estate affidavit alone cannot transfer title to the home. By contrast, a home properly funded into a trust can be managed and distributed under the trust's terms, making a living trust worth considering.
Texas — There are ways to transfer property other than a trust
또한 텍사스는 Transfer on Death Deed(TODD)를 허용합니다.
For a death without a will (intestacy), a Small Estate Affidavit may be used for a qualifying estate of $75,000 or less (excluding certain homestead and exempt property, and subject to court approval and heirship requirements). Texas also allows a Transfer on Death Deed (TODD). Under it, a property owner designates a beneficiary during life and records the document, so that upon death the owner's interest in the property transfers to the named beneficiary. However, the document must be properly recorded before the owner's death, and existing mortgages and certain creditor rights are not automatically extinguished.
6The 2026 federal estate tax exemption is $15 million
One notable change for 2026 estate planning is the basic exclusion for federal estate and gift tax. According to the IRS, for U.S. citizens and residents (for estate tax purposes) who die in 2026, the Basic Exclusion Amount is $15,000,000 per person.

In addition, married couples who meet the requirements may consider a Portability Election, under which a surviving spouse succeeds to the deceased spouse's unused estate tax exclusion. However, this does not apply automatically and generally requires a proper Form 706 filing.
Will creating a trust eliminate estate tax?
Not necessarily. Because a typical revocable living trust lets the settlor control and revoke the assets during life, those assets are generally included in the federal estate tax calculation at death. In other words, merely creating a living trust does not by itself reduce federal estate tax.
7If you are a Korean living in the U.S., review your Korean assets too
Estate planning for Korean American families may not be solely a matter of U.S. real estate and bank accounts. If you have an apartment in Korea in a parent's name, or hold Korean financial accounts or assets you expect to inherit, the laws of both the U.S. and Korea may apply.
Particularly important is that U.S. citizenship, permanent residency, tax domicile, and the location of the property are distinct legal factors. A U.S. citizen's worldwide assets, including those outside the U.S., may fall within the scope of federal estate tax. Even a non-citizen may face a similar taxable scope if their domicile for estate tax purposes is in the U.S.
Holding U.S. permanent residency alone does not conclusively determine domicile for estate tax purposes. And a trust created in the U.S. does not by itself resolve the transfer of real estate or financial assets located in Korea (Korea's inheritance law, registration, and tax rules may need separate review). So when you have assets in both countries, it is important to consider not only the validity of your estate documents, but also the possibility of double taxation, beneficiary status, property-transfer procedures, and filing obligations in both countries.
8Who needs a trust, and who may be fine with a will alone
Not everyone needs the same estate plan. If you own no real estate, have a simple asset structure, and have clear beneficiary designations on your financial accounts, you can prepare much of your plan with a will, a power of attorney, a healthcare directive, and proper beneficiary designations. On the other hand, in the following situations it is better to more actively consider the need for a trust.
- You own rental property or real estate in multiple states in addition to your home
- You want to distribute assets to minor children based on a certain age or conditions
- In a blended family, you need to clarify the division of assets between a spouse and children from a prior marriage
- You need separate management after death for a disabled family member or a beneficiary who needs help managing assets
- You place importance on privacy and continuity of asset management
- You hold assets split between the U.S. and Korea
9Five things to check if you already have a Living Trust
It is easy to think that because you set up a trust a few years ago, there is nothing left to do. But a trust must continue to be maintained to match your actual family relationships and asset situation after it is created. Check the following five items during a review.
10Estate planning is preparation for the family left behind, more than the assets
You don't need to think of estate planning as a document only for the wealthy. It can be important for a parent who owns a single home, for a couple with young children, and for a family divided between the U.S. and Korea. The purpose of good estate planning is not simply to reduce taxes or avoid court. It is to make the decisions your family will need while you are healthy, and to reduce the potential for confusion and dispute in managing and transferring assets even in unexpected situations.
A will is an important tool for deciding whom your assets will go to, and a trust is a tool for designing more specifically when, by whom, and how those assets will be managed and distributed. Which method is appropriate depends not only on the size of your assets but on your family relationships, where your real estate is located, your tax situation, and your long-term goals. Estate planning is best prepared not as a problem for your family to solve after death, but while you are alive and able to set out your wishes in legal form.
