The 2026 U.S. E-2 Investor Visa —
Is $100,000 Enough?

From launching or buying a U.S. business to changing status, bringing family, and the path to a green card. From the "minimum investment" myth to what really matters in 2026 — explained by a Korean-focused immigration attorney.

In Short
There is no fixed statutory minimum for E-2. What matters is not the dollar figure itself but the lawful source of funds, funds truly at risk, a real and operating business, and the investor's power to develop and direct it.

For Koreans seeking a new business opportunity in the U.S., the E-2 treaty investor visa remains a powerful option. Unlike the large-scale EB-5, E-2 has no fixed statutory minimum, and — if you qualify — you can run a business and live in the U.S. with your family.

But money alone does not qualify anyone. Officers look not at your balance, but at whether the funds were lawfully earned, truly invested and at risk, whether the business can genuinely operate, and whether you have the ability and authority to develop and direct it.

What Investors Ask Most

· “이미 미국에 있는데 한국에 돌아가지 않고 신분을 바꿀 수 있나요?”“Can I get E-2 to buy a small business or run a franchise?” · “How much do I need to invest from Korea?” · “I'm already in the U.S. — can I change status without going back?”

01 — What E-2 Is

What Is the E-2 Treaty Investor Visa?A nonimmigrant visa to develop and direct a U.S. business

E-2 lets a national of a treaty country invest substantial capital in a U.S. business and live in the U.S. to develop and operate it. Korea is an E-2 treaty country, so Korean nationals may apply if they qualify. Common ventures include:

Restaurants and cafés; buying or opening a franchise
Convenience stores, retail, and service businesses
IT, software, and professional-services companies
Acquiring an existing U.S. business; logistics, distribution, and other commercial enterprises
Industry ≠ Eligibility

That an industry is eligible does not mean your specific business qualifies. It must be a real, operating, for-profit enterprise — mere real estate holdings or passive investment generally will not qualify.

02 — The "$100,000" Myth

Do You Really Need $100,000 for E-2?"Substantial," not a fixed number

Bottom line: there is no uniform statutory minimum for E-2. The familiar $100,000 is not a legal floor. The law requires a substantial investment, measured against the actual cost of establishing or buying the business. The figures below are illustrative only — not approval thresholds or per-industry minimums.

Small service business

Café or retail

Franchise
$200,000
가상 투자 예시illustrative only
Buying an existing business
$350,000
가상 투자 예시illustrative only

Investing $70,000 in an $80,000 startup is very different from $70,000 in a $500,000 one. What counts is not the absolute figure but whether the investment is substantial relative to total cost and sufficient to actually run the business. The funds must also be more than parked in an account — they must be committed and genuinely at risk, hard to recover.

A Practice Tip

When signing a purchase agreement, always address what happens to the funds if E-2 is denied. A well-structured escrow can reconcile the "at-risk" requirement with protecting your money.

03 — The Four 2026 Essentials

Four Factors That Decide E-2 CasesAll grounded in existing E-2 law and regulation

Source of Funds Source of Funds

The government verifies the funds were lawfully obtained. A balance letter is not enough; you may need proof of earned/business income, a Korea property sale and transfer records, gift/inheritance documents with the donor's source, international wire records, and U.S. business account activity. The key is an unbroken money trail from origin to the business.

Develop & Direct

E-2 is not for a passive investor collecting dividends. You must be able to develop and direct the business — typically by owning at least 50% or otherwise showing real operational control. In joint ventures, review not just ownership but voting rights, operating agreements, management, and deadlock provisions.

A Real, Operating Business

Registration papers alone rarely suffice. Depending on the business, show a lease, equipment, licenses, supply contracts, expenditures, and hiring plans that prove it can really operate. A business plan with market analysis, revenue/cost projections, strategy, and staffing helps — though no single 3–5 year format is legally mandated for everyone.

Non-Marginality

The business must be non-marginal — more than enough to provide a minimal living for you and your family, now or in the future. New businesses can show future capacity, and the rules generally look at the potential within five years of starting. Hiring U.S. workers helps as evidence, but there is no flat requirement to employ a set number at filing.

Changing Status in the U.S. vs. Getting the Visa in KoreaTwo different processes — and a crucial gap

If you are lawfully in the U.S. in a nonimmigrant status, you may file a change of status with USCIS. Even an F-1 student or B-1/B-2 visitor can prepare for E-2, but first check your status's limits and your eligibility. If a visitor begins unauthorized business operation or work, that can violate status, and inconsistencies between entry intent, later activity, and past statements can raise misrepresentation. Being in the U.S. does not automatically make change of status the better route.

Remember This

Even after a U.S. change-of-status approval, a consulate will independently re-adjudicate the visa if you later apply abroad. An approval notice does not guarantee a visa.

05 — 60 Months ≠ Your Stay

Korea's E-2 Lasts 5 Years" — Don't Confuse It With Your StayVisa validity vs. authorized stay

Korea's E-2 visa can generally be issued for up to 60 months (5 years), multiple entry, under the State Department's reciprocity schedule. But that does not mean you may stay five years at a time.

07 — From E-2 to a Green Card

Can E-2 Lead to a Green Card?E-2 is nonimmigrant — but paths exist

E-2 is a nonimmigrant status, so time alone does not produce a green card. Still, depending on your situation, separate immigrant paths may be available.

Family-based — if you independently qualify
E-2 & Immigrant Intent

An E-2 applicant must intend to depart when status ends. Merely exploring a future green card does not auto-deny E-2 — but concrete signs of immigrant intent can create problems at visa issuance or entry. If permanent settlement is the goal, design the E-2 structure and the green-card path together from day one.

08 — Five Common Mistakes

Five Mistakes E-2 Investors Actually MakeAvoidable risks, from the file room

A sound acquisition can still fail E-2. Review nationality, ownership, operations, and money flow before closing.

"Available" money is not "at-risk" investment. Show the funds are irrevocably committed to the business.

Permitted prep (forming a company, negotiating) differs from actually operating or working. Unauthorized activity can gravely affect a later change of status.

A USCIS approval is not a passport visa. Re-entry usually needs a valid E-2 visa, and leaving while a case is pending has its own risks.

Ceasing operations or materially changing ownership, structure, or line of business can jeopardize status and may require new USCIS approval or consular review.

A Word From Attorney Chris W. Chong

A good business is not automatically a good E-2 case — and a modest one can be, if the evidence on amount, structure, source of funds, and operations is solid. The key is not to wire the money first and think about the visa later, but to build the immigration requirements into the deal from the start.

When the legality of funds, ownership and management, the filing route, your family, and a future green card are designed as one, you cut unexpected legal risk. Starting a U.S. business is not just a visa filing — it is planning your assets and your family's future together.
