The H-1B Bar Is Rising Higher
On September 18, 2026, the administration issued two presidential actions on H-1B: a proclamation extending the $100,000 payment requirement for certain new H-1B workers by another year, and an executive order directing agencies to scrutinize H-1B more closely. But a federal court struck down the $100,000 policy in June 2026, and the government's appeal is pending.
H-1B, the main U.S. professional work visa, is again in flux. On September 18, 2026, the Trump administration took two H-1B actions: extending by one more year a $100,000 payment requirement on certain new H-1B workers, and directing agencies to scrutinize H-1B more closely. In short, both the cost side and the vetting side are getting harder.
But headlines can mislead. Some measures are already in force, some are only proposals, and some are being fought in court. Below, we answer the questions clients ask most — in plain language.
What exactly did the administration change for H-1B?
Two things came out on September 18, 2026. ① A proclamation (an order the President issues directly): it extended, through September 21, 2027, a rule requiring a $100,000 payment for certain new H-1B workers. ② An executive order: it directs agencies like the DOL, DHS, and DOS to review H-1B filings more closely.
In short, the H-1B bar is rising on two fronts at once — cost and vetting.
What's the $100,000 payment, and who has to pay it?
It extends by one year an H-1B restriction first set in 2025, and applies mainly to certain new H-1B professionals outside the U.S. Their petitions must in principle include the $100,000 payment. But the government (the DHS Secretary) can grant exceptions by person, company, or industry where it finds a national interest.
So do I have to pay the $100,000 right now?
Not necessarily. A presidential extension does not make it legally final. In June 2026, a federal court in Massachusetts found the policy implementing the $100,000 unlawful and vacated it. The government appealed, and the appeal is now pending.
So neither "it's back in force" nor "it's gone" is accurate. This is best seen as a stage where executive policy and the courts are in conflict.
And what's the $103,265 in the news — is it the same $100,000?
It's a different thing. This is not the proclamation — it's a separate DHS fee proposal from August 25, 2026. It would add $103,265 per petition for cap-subject (lottery) H-1B filings and U.S. advanced-degree filings. It is still only a proposed rule, with comments open until September 24, 2026.
Proclamation
Presidential proclamation
H-1BMainly new H-1B abroad
Vacated · on appeal

What does the "enhanced vetting" order mean for employers?
Honestly, this may matter more than the fees. The order has multiple agencies share data and look at the employer's overall employment situation — across the H-1B petition, the Labor Condition Application (LCA), visa issuance, and entry.
Where review used to focus on "does this worker meet the specialty-occupation test," it now extends to "how is this company using its workforce."
We recently laid off U.S. staff — will that hurt our H-1B?
It can, so take care. The order tells officers to weigh whether the sponsor laid off similar U.S. workers in the past year — or plans to. These records may matter more:
Recent restructuring / layoff records
Actual role differences: U.S. vs H-1B staff
Why the role couldn't be filled (recruiting)
What the H-1B role actually does
Proof the required wage was paid
Third-party placement / consulting contracts
Real link between degree and job
Will the required H-1B wage go up too?
Possibly. The DOL wants to change how the prevailing wage is set for H-1B and employment-based green cards (PERM). Employers already must pay the higher of the actual wage or the prevailing wage. The plan would revise that formula to track real market wages more closely.
Not final yet — but a higher wage floor would directly affect PERM green cards, not just H-1B.
Can my spouse (H-4) keep working?
For now, yes — but watch closely. DHS's long-term list includes ending the rule that lets certain H-4 spouses apply for a work permit (EAD). But it is not an in-force rule — it's only a long-term item with no set date.
So don't assume H-4 work authorization is already gone.
If I'm laid off on H-1B, do I have to leave right away?
Not immediately, for now. Today, if you meet the requirements, there's a grace period of up to 60 days after your job ends to find a new employer or change status. But in 2026 DHS sent a rule to eliminate that 60-day grace period for internal review, which ended August 27. It's still only a proposal — the grace period has not disappeared.
Does this also affect student OPT?
Yes — you can't separate them. Many U.S. graduates move through OPT or STEM OPT into H-1B. So when OPT costs/limits and H-1B costs/vetting tighten at the same time, the whole hiring pipeline narrows. ICE is pursuing a 2026 OPT fee rule; internal review ended September 11. Not final yet.
The Most Confusing Part — Separate "Already in Force" from "Only Proposed"
You'll see alarming lines like "H-1B is effectively abolished," "spouses can't work," "leave immediately if laid off." But not all "H-1B news" carries the same weight. Sorting these five clears up most of the confusion:
Proclamation — an order the President issues directly
Executive Order — a directive to agencies
Proposed Rule — not yet in force; comment stage
Final Rule — confirmed and actually in force
Court Order — can vacate or pause a rule
As of September 2026, some are ordered, some are being litigated, and some are only proposals. Making big employment or status decisions off headlines alone is risky.
The Real Question Isn't "Can We File?" — It's "Can We Explain It?"
If you're an employer, the key going forward is whether you can document why this worker is needed, why the role is a specialty occupation, that you pay the required wage, and how it relates to any U.S.-worker layoffs. Firms with recent layoffs or consulting / IT-staffing / third-party placement models should organize employment records and role structures before filing.
If you're a professional, rather than betting on H-1B alone, check early whether O-1, L-1, E-2, NIW, or other visa / green-card paths also fit your background.
Bottom Line: Follow the Rule Actually in Force, Not the Headline
H-1B policy is moving fast, mixing what's already in force, what's only proposed, and what's being litigated. Deciding big employment or status questions off a headline — for a company or an individual — is risky.
If you're planning a new H-1B, a change of employer, status after a layoff, H-4 work authorization, an OPT-to-H-1B move, or a long-term green card strategy, act only after checking the rule that actually applies now against your own situation.
